It's a Chrysler minivan. People who drive those don't pay attention where they are going. I used to have one, and I found myself suddenly parking crooked, driving over 2 lanes, and then well it's gone. Now I drive my MK1's, and park straight.

Depends when the collsion occurred. It's light in the pictures, but it's quite possible that the accident may have occurred hours before, say in the pre-dawn dark.
Investigations involving death can take hours. If the person is obviously dead and pronounced at the scene, that person can stay where-is as-is for quite some time while they investigate around him.

ROFLMAO. Good one. By the pics, I'm going to guess that the backhoe was parked, and the person either passed out, or fell asleep or whatever. Those things are pretty bright, and the headlights on those vans are bright, well, the few that have both of them working are.

Backhoes tend to get dirty. They rarely have large expanses of bright highly polished paint or chrome decorative trim to shine and reflect your lights back at you. Though they "should" have flashers and/or beacons on while travelling at night, many do not, or they are obscured with caked on dirt, or they're damaged and not working. Also, looking at them from the rear, you don't really see a lot of bodywork expanse - much of the rear profile is taken up by the gray/black rear tires which tend to become invisible after dark, and the backhoe bucket which get real dull and dirty real quick.

And who operates these things at night? Operators driving pre-dawn to get the equipment to a job site before morning start-up is one that I have seen more than once.

So you take one not-necessarily-very-visible piece of equipment, and often a generally slow moving at that, and stick it out on a road where the average motorist isn't going to expect its presence, and you end up with huge potential for a rear-end collision. It happens more often than you might think, parked or moving.

this why the company i work for doesnt allow us to move our equipment at night.....day light only and if gets there late you wait for it.......but odds are the backhoe was parked for the night (sewer or water job)

If you want to see the images... Just open the image in a new window and keep changing the name of the image to Car2, Car3, car4 etc ...

You'll see all of them...

Seemed like the guy really wanted to die cuz doesn't look like he even attempted to turn it...!!!
