Question

theoretically speaking....let's say a person was speeding on the highway and needs to get off on the next exit which is like 100m from him, but there happens to be a cop on a bike chasing him(the driver didn't realise this) and as he just makes the turn the driver happens to glance in his rearview mirror and see the cop, the cop happens to not be able to make the turn in time because the driver just made it himself and it was just too dangerous for the cop to do so as well. As the driver continues on, he looks at the cop continuing down the highway and the cop gives him a hand gesture which meant, what the hell are you doing?!?!? At this point, the driver thinks to himself, "holy , i think i just outran a cop without even knowing that he was chasing me." The driver drives back home where he was headed without being stopped by any cops on the way. Now, can he still get a ticket the next day or week? If so, would they also charge him for disobeying the cop even though he didn't mean to since he had no clue he was being chased? Can this be faught in court and what are the chances of winning?
Again, this is just a theoretical question.

oh lol. the funniest thing ever. i can just imagine the cops reaction

Charlie_Chaos 09-22-2006 12:53 PM

:lol_hitti

It would be the person who was being chased obligation to pull over and wait for a few min.

IF the cop dosen't show there off the hook.

If the person just continued to drive and the cop had the plate number the person mentioned would be VERY F^CKED

Cop has the plate number = Faliure to stop ticket + whatever ticket you're getting - no jail time unless you're a dumbass and admit to driving the vehicle, then they'll lock your ass up.

Cop doesn't have the plate number = Officer lsot visual sight of the vehicle and there is no consiquence.

Uhh.. if you DON'T admit to driving the vehicle... they still want to know WHO was.... so A) you'd better have a Police report of your car being stolen (too late now) B) admit it was you driving C) give them the name of a friend you feel like fu.cking over, and hope he doesn't have an alibi...

You just tell them that you were not driving the vehicle. They'll want to know who it is, use ignorance, there is no way they can prove you were driving it. That's why they don't give points at red light cams :retard:

Oh man, that's hilarious. You'd better hope he didn't get your plate. Although, if he had, I'd figure he'd already be at your house.

There are several HTA offences where the owner AND/OR the actual driver can be charged for moving violations involving a vehicle. You as an owner could claim ignorance as to who the actual driver was at time of offence, bit you as the owner could still be charged for the offence as if you yourself had been driving the car. The cop would not have to prove that you were actually driving the vehicle, but only that the vehicle was involved in a specific traffic offence and that you were the owner of that vehicle at the time.

I suggest you forget that you ever seen him in your rearview mirror. If he shows up, say you were elsewhere. Have the cop do all the leg work.
You werent on that road, and you DEF. were not speeding. :veryhappy

Maybe ask him if he wants a beer for the road :veryhappy
*see other thread regarding peel cops getting busted boozing it up

Ok listen up...

For such an offence, they will want to know WHO was driving the car... if you don't tell him... they WILL charge you regardless. Since it's YOUR car, and it's YOUR responsibility. Plain and simple
