So this happened to my car last friday

Dropped it off to be repainted at a body shop on milwick drive in north york and i went to florida. Came back with a phone call from the police and a letter in the mail stating that my car had been in an accident and was totaled. No new news yet other than the driver took the car from the body shop where he worked and was doing over 220km/h on 401 and 427 and was arrested on spot and is in custody, the shop on the other hand has to shell out some money after we're done sorting out this mess. The car was impounded and we had a $900+ bill to pay, as well as the guy who stole the car also hit a opp cruiser and we have to pay for the damages too. Apparently because we own the car, and my insurance was kicking in this past thursday, they're not covering anything.

WTF... that is some serious BS. I hope the company doesnt just fold because of the bill.

That is unreal though! I am sure it will turn into a headache!:(

I agree, this is going to be a headache. Get a lawyer, look over your insurance contact, file against the guilty, the body shop, and your insurance company. Don't get some hole in the wall lawyer either, insurance companies have devils for lawyer's...

:smile:People owe you a new car... and probably more.

I know in the US there would be a list of things to file against them all starting with pain and suffering.

well the suspect being charged is going to court this week, from what I've been told by the opp officer. Other than that, I may not have to pay for the damages to the cruiser but the car is now parked up at a friend's place and im gonna have to end up selling it for parts to make some of my money back as the insurance say that they will not cover any damages because the policy was going to be activated as of the past week instead of the week before. My lawyer will be in contact with both the insurance and the accused.

it doesnt matter what the ins comp says. you didnt need insurance. the shops employee stole the car and wrote it off. the cops are being dicks and cant charge you with . your car was stolen and then was involved in a police chase. the kid who stole it is gonna get charged and is gonna end up having to sell his tight little ass to make some money and reimburse you. and that shop despite what they say are responsible for your car. it was on their property, taken from their lot. which means if they dont cover it their insurance has no choice but to. chances are theyre gonna want to settle with you and not involve their insurance as its gonna go up with somethign like this.

man im sorry to hear about your car, that was a nice E36 as well. Are you able to name the shop so i know what bodyshop NOT to bring my car anywhere near?

heard about that on the news, sorry to hear.

IMO I wouldnt leave my car to any of the shops on Racine rd. area or this millwick area... Lots of theives.

monday I will be appearing in court to hear the verdict and also make arrangements as to what i would like done with my car, they are saying that the bodyshop will pay for all damages to the cruiser, and compensate for the impound fees that was paid by myself. As for my car, the bodyshop has a few options either pay for damages ie; price the car was purchased and work that i did to it myself plus registration of the vehicle, or the fix the car back to how it was when i dropped it off to be painted. So far my lawyer is telling me to take the money and forgot the whole thing, plus i will still have my car so i can sell it for parts and make back a bit of extra money.

Sounds like it's became less of a nightmare then I was thinking! That is some good news to read IMO. I agree with your lawyer, get another car, part the bashed one and put this behind you.

I'd personally try to get them to fix it. You put work into the car. Why start over? A new car wouldn't mean as much I think.

this is what you get when any punjab who can't read english, can bring 10 cousins over to the new world and start up a body shop in Markham.

i am sorry to hear about your missfortune. i've been burned a few times myself, and recently a friend of mine had the exact same thing happen to them. what pisses me off is the lack of ethics of ALL ****ing parties involved, in this case, OPP is included, ****ing koksaakers, they are there to serve and protect, paid from your taxes, and they just choose to become an extra stressing party : "oh you have to pay for our car, even though this has nothing to do with you"

What this deal has to do with is :
- improper business licensing
- improper business procedures moderated by the govt ( people )
- lack of ethics and profesionalism
- stupid ignorant ****ing cops

Everyone is at fault BUT you, yet i'm sure, aside from the dumb**** that stole your car, you got it the worst :(

P.S. to the ppl basing me for pointing out ... how could i shut up ... just look at this guy ... and many like him ... just wait till you get burned ... i wonder what your brainwashed minds will allow you to think like then ... i wonder if you would actually end up blaming yourselves for something like this happening to you . and you should blame yourselves . because with like this arround the only things canadians meet publicly to support are weed and gay pride .

P.P.S. ... i wonder who contacted their MP after this

hey guys i know quite a few people pm me asking what ever happened to the car, well the guy went to court and apparently they ordered the shop to pay for all impound and towing fees summing up to $1200 and they have to fix the car back to safety standards and not just driveable conditions, and it will need to be taken to an MTO office for inspection afterwards, the guy who took the car has 7200 hours of community service to do as well as pay $2000 for the damage done to an OPP cruiser, and he needs to show the judge all fees paid in full or else the bank/government will seize all assets owned by the shop and pay me for the damages. So now its just a waiting game to see how long they are gonna take to fix the car and put it back onto the road.

talk about slap on the wrist.. but glad to hear that you're no longer being held responsible for anything are they paying for a rental as well? i hope so.. also what shop is doing the repair? i hope its not the one that is responsible for this mess..

I would have thought the body shop should have to cover something , cause it was taken from their property by one of their employees . Even though work orders state not respons for property left on premises . It was their own people that took it .
I,d take the money deal , part or sell the car and start over unless its spomething you really want . With a hit like that guaranteed 2 yrs down the road , wind whistles and door seal leaks . the seam sealer will be broken open places u cant see and water will get inside the car especially around the wheel wells ..77.

yup good call, its gonna have problems down the road, either take a cash deal or have them fix the car and sell it. personally i wouldnt let that shop fix the car, id demand that another shop fix the car properly at this shops expense

Ok so after about a month of going to and from the shop I'm getting the car fixed as we speak at another autobody shop that only deals with hi-end executive and luxury cars. The owner said that he would even warranty the car for 3 months after he's done with it cause it will be in mint condition when finished. The other shop is paying for the work to be done and the impound fees and damage to the opp cruiser. All in all after this is done, im gonna just do the work myself when it comes to my cars, even though i do most of it already.

btw does anyone know where i can find a set of hid fog lights for this car? As well as tinting 5% rear and 20% front?

I have been told that Audioheaven is excellent for tinting in terms of product quality and customer service.

Should be no more than $200 tax in...you just need to haggle with them a bit.
