i own the .com as well and currently its not for sale.

I know... but what I'm saying is that is not wise to sell a .ca without selling the .com with the package... It's a huge legal Issue... Specially since you currently own both...


also, i'm not trying to ruin your thread, however I want you to look at the Legalities before making the sale.. :smilie_da

legalities for who... Im not worried about the discussion in here, i can modify it if need be.

The purchaser can buy both if he'd like, but on the .com he be paying for the traffic that still goes through it.

Someone motivated in the scene, this would be a great start to take off from where TSR left.

You see, what happens is that let's say someone buys the .ca... and 2 months later I buy the .com...

If I decided (and most likely would) Incorporate or Create a legal trademark out of Toronto Street Racint (TM) or Toronto Street Racing Inc. I have the legal right to cease the .ca Corresponding to my trademark.

Even owning the .com makes you owner of a semi-legal Trademark... So in reality you could sell the domain, but you could re-gain ownership at any moment without having to pay anything.

I am familiar with some corp. law, inc'ing and trade marking.

Trade marking / inc'ing can be applied to anything, car club names, websites, sticker designs / logos etc. Doing so in bad faith does not guarantee you a win by any means.

Now, i cant imagine how many people out there are NOT buying domains because they’re worried about people going out of their way to go through hoops to in the end, spend money on a cease and desist.

If .ca is making reasonable revenue or the user feels its a great name, they’ll protect their assets, vise versa. If they’re generating enough money they may fight you in court, not to say they will win, but they may fight.

Don’t be fooled, people can appeal and that domain will sit in limbo until there is resolution at which point the owner still has 90 days to meet all resolution needs. I would not be surprised if there was a counter ‘bad faith’ complaint filed. Again, if you have money to blow and believe you have more than the guy you’re going after, go for it.

Owning a .com is not a semi legal trademark, you either have a trademark or you don’t. As for me selling a domain and implying copyright infringement to commence a legal battle is kind of lame. Sure, someone out there may do that, i may not. Likely hood of it happening, slim to none. And don’t be fooled, your trademark and inc better pre date domain registration, or your law suit wont be that easy. Bad faith registrations will usually get tossed.


I can assure you that both domains have and can generate substantial revenue. Enough to justify inc'ing and trade marking.

So, to say to someone DONT buy a domain name because you don’t own the rest and may (term used VERY loosely) is silly.

.com .net .org .biz .info .us .tv .ws .name .cc .de
.be .at .uk .nz .cn .tw .jobs .am .fm .ms .nu .tc
.tk .vg. ca .ue .mobi

That all being said, snapping your fingers and getting your domain or a similar domain back doesn’t just happen unless you’re google, ibm, Microsoft etc.
