2 Stop Sign ticket same day - need help
 
Dear Friend,
I am searching this site to see if any of the member had fought a stop sign ticket before and how is the best way to get away with it. Friday night I was with my family on a street which has 4 stop sign I remember stoping at the 1st and the 4th stop sign but the police pulled me over and said that I fail to stop and the 2nd and 3rd stop sign which I did not see, I recall it was a curve to the right and it was around 6:30 p.m then He asked me for my insurance slip and my wife did not have in her car at the moment so She issued 3 tickets on me, 2 for the stop sign and 1 for fail to surrender a insurance proof at the scene.
Please any advise it will be appreciated!.

Well Then
You have 2 options

Fight it yourself, Fight it with some help

First thing you should do is file the ticket at the court...... This extends your time to make a descision by several months :)

If you need help, find a paralegal to help you. Because she issued the ticket TOGETHER (didnt stop you twice) they can do them as one ticket.

Find a paralegal in your neck of the woods at www.imintrouble.ca and at least talk to them to see what your realy options are.

I think I am going to fight it myself, the paralegal wants $300, I think I can use that to pay the fine and have some money left. first I will go and ask for a court day, so after that I wait for the letter in the mail and then ask for the disclosure, anything else I should know darkdrgnk2 ? by the way thanks for the answer you were the only one who take your time to reply to me!

Yeh 300 is about what it normaly costs... I know the ticket like under 100 buc you have to concider is that the 300 bucks might save you some insurance premiums too.

I was chareged with like a 5 over.... and paid for it for 3 eyars after that..... should of when to fight it :-S

But if you fight yourslf, basically it goes like this

1) If it takes more then a year (or close to it) to get a court date investigate a potential 11B charter argument - took their sweet time getting to court and you suffered anxiaty, and dont remmber details that long ago yadda yadda yadda (more info in http://www.mytrafficticketcefence.com ) If you are gonna use that file the necessary paperwork at least 15 days (if not sooner) before the court date

2) At the trial ask if the officer is there.. chances are the answer will be yes.. if not... you are home free

3) Plea bargening . see if the prosecuter will drop the charge for a differnt.. maybe "disobay official sign" (0 points). You alwasy want to go DOWN in points (oviously) If you want to take this way out.. accept the deal.. your home free.

4) All else fails get ready for trial. Make sure you read up on the actualy definition of the section of the HTA you where charged with, this include definitions (once again www.mytrafficticketdefence.com has a section on taking apart the charge.)

You are not proving that it wasnt you runnign that stop sight, or proving you where teh one running that stop sigh.

You have to prove that the officer cannot meet all the requirements of the LAW to convict you of the charge.

i had this same scenario..ur either going with option 2 or 3..i got option 3 no insurance hikes nothing..gud luck

Just to be clear, when the police ask you for insurance, they want to know the driver is insured either through their own insurance policy or through the insurance policy of the vehicle owner. If YOU don't have any insurance then you need the owner's insurance slip. Is it possible you misunderstood what the police officer was asking you for?

Courts generally allow 18 months from the time of offence to the court date. See
