Hi guys

Car: Nissan 350z, nismo body kit, 18” rims, carbon fiber interior

I was driving home last week and a cop alleged that I was travelling 133km/h in an 80km/hr zone. My license was suspended and my car was impounded. She didn’t even reduce the speed. This is how it happened, I was driving and there was a car coming in the opposing direction. Behind that car there was a cop car hidden, and behind that car was another car. I was on a one lane highway. And she turned around when I passed her.

So I’m pretty much screwed now.

1) I was heading home for a funeral, I am currently working about 3 hours away from Toronto, and it was getting dark.
2) I am a University student (Masters), it is going to be extremely difficult for me to go back to school in September now.
3) I have a clean driving record and have never even got a speeding ticket.

I am aware that only 33% have been convicted under this new legislation, and Im also aware that quite a few got this charge dismissed. I was really cooperative with the cop, and didn’t show any attitude what so ever.

If there’s any one out there who can offer me advice or knows someone who had their charge thrown out, please help.

cause he doesnt wanna bus it advice for next time. your car is fast enough to get away, so dont stop.

aside from that, go to court, and hope they drop it down to something a little better and you only have to deal with some money loss and an insurance hike. better than the 50 over bullshit

That's just stupid advice. Can't outrun a radio, plus if you do get caught then you're in for a REAL s***storm.

Take it to court. Did the cop say that your were clocked on the radar at that speed? Find out if the cop was qualified on the mounted radar unit, request a copy of the notes. Generally if you plead with an explanation then the JP will knock it down for saving the court's time. Still, if you were actually going that fast then you kind ask for stuff like this.

Dude, are you on crack?

I don't care how fast you think your car is .. Believe me, you will get caught if you run.. Even if you do get away initially. You have a thing on your car called a licence plate, and it's registered to your name, and your address.

the 50+ legislation is also provincial. If you run from the cops, it then becomes criminal, and pretty much you will be screwed for life once you decide to drive away from cops..

^ So you've never done 50 over the limit anywhere? It takes 115km/h to make a pass on a two lane 80km/h zone in most areas. 130 isn't that fast, relax cowboy.

I hate hypocrites that call others idiots because they got a ticket. Everyone's an idiot if they get a ticket, yet no one else ever does anything illegal. He didn't ask for Grandpa to come in here and lecture him, what difference does it make what car he can afford? Do us a favour and shut yer ball washer...

To the O.P. Do whatever you can before court, be as prepared as possible. I'd use excuses like "my wheels are bigger therefore they nay throw off the speedo, thought i was going 125" or something of the like and try to plead guilty to a lesser speed infraction. Best of luck, sucks gettin' pegged with it.

I just got one today in the Jeep Rubicon on 37" tires, 107 in an 80. I didn't think I was going that fast, cop was nice and knocked it down to 15 over. No biggie, tickets suck. Gotta pay to play though.

I agree with judge don't stop, but set your car up for it first, hook up a switch to your lights so it cuts all the lights but the headlights and go. Chances are they didnt see the plate before they spun around. Just make sure you have a good knowledge of the area and know where all the spots are that you can hide. You just have to sleep in the car till morning or be close to a hotel and you are good to go. The only problem with this is you have got to be far enuff that they cant see your plates, and there has to be a turn near by otherwise you are done. Or you could just slow down.

From my knowledge there is no caselaw for this ticket, so its hard to fight.

If you go to trial youll probly loose your best bet is to pleed it down!!!

But im no lawyer.. seek some realy legal advise, most places will talk to you for free.

Sorry to hear this, but from the news 1/3 of those "racing" ticket had been disputed due to insufficient evidents, good luck.

To all those who are saying to run from police.

I am re-emphasizing, You are outright RETARDED. IF it's for a simple ticket, are you willing to risk your life, your freedom, the safety of everyone else on the road, and your licence? Are you willing to go to jail? Are you willing to loose your licence for ever?

If you get a ticket for stunt driving, bring it to court and get a lawyer. If the 33% conviction rate is true, you have 66% chance you will not be found guilty of it. You can also plea to a lesser charge, etc. You'll walk away, call for a taxi or a close friend, and be in your bed the same night. You'll get a court date, and you'll get a chance to get off scott free.. Even if you don't, all you have is a provincial conviction, which is not even criminal, so, you'll be without a criminal record.

If you RUN from police, you won't only be done for street racing, you'll be in over your head with CRIMINAL charges, including other charges such as dangerous operation of motor vehicle, fail to stop for police, etc. You'll be eventually stopped, you'll be ripped out of your car, thrown onto the pavement, you'll be handcuffed, You'll be brought to the station, strip searched, placed in a cold cell and believe me, you'll stay in jail... And there are no chicks in jail, no beer, no freedom. Sure there is a chance that the cop won't get ur plate, and you'll be gone like the wind... But just remember, radiowaves are faster than any shot of NOS u have in ur trunk. For all you know the cop could of got ur plate, but not persued, and put ur car on the system, meaning u'd be arrested some other time ur driving down the road...

I leave the decision up to you. It's one way or the other. The other isnt so appealing ...

On outrunning cops: radio waves travel at the speed of light, NOS doesn't. Ever see an accident on the side of the road and then 3 cruisers, 2 fire trucks and an ambulance all within a couple of minutes? And you wonder where did they come from and how did they get there so fast? Not to mention air OPP in the sky above you.

R Bains, you didn't say where you got the ticket and which force stopped you. But it sounds like basic radar setup in a cruiser and a quick "got you in my sights" situation. Pretty hard but not impossible to prove. The problem is there's not enough time for a visual estimation or for cruiser confirmation speed (the low doppler signal). Both have to be done to determine the radar is picking you up instead of someone else.

Second, the rounding error alone could knock of a couple of kms from the reading. You were caught just on the wrong edge of over 50 so every km that can be knocked off will work in your favor.

There are tons of other possible errors unless the road was straight and flat and there were no vehicles behind you.

Several jurisdictions are not prosecuting the street racing law but offering a lower charge because they are afraid of the potential constitutional challenge (+ the two already before the courts).

Finally document everything including your expenses. You can sue to get the tow fee and loss of use back. (As long as you are never convicted.)

Get help, you will need it. You can fight this and you can win.

Suing for impound rates will be extremely hard to win, especially with the laws written in legislation right now .. You'd probably never win, until the laws are amended, and if the event happened AFTER the amended laws.
