Accident while being sick, now court, how to explain?
 
Hi all,

here is my story.
I was driving in the morning and then suddenly fall asleep, basically I rather fainted. After that I hit traffic light pole, nobody is injured. The cop gave me a ticket for $300+ and points. I realized that something is wrong with me and next day went to hospital.
They diagnozed me with some sort of brain inflamation which caused the sleepiness. At the time of the accident I did not know about my sickness. Now I took a letter from my doctor which confirms that I was diagnozed with such thing and that I spent a week in hospital.

Now I have to go to the court. How should I present all the information to the judge? Will the fact that I was sick and did not know about my sickness help to cancel the ticket and win the case???

What do you think?

bring the paper to court.

However, if you DO notify the court that it is caused by a medical condition.... They will probably suspend your DL as per medical reasons.

Or if you told the cop that it was because you fainted because of med reasons, seizures, etc.. the same.

You didn't happen to knock over the light post on McCowan road the day before? I wondered how a car could break that thick metal pole.

I think you're in a lose / lose situation. If you don't report the medical condition you'll have to fight the points and ticket, if you do report it then you may lose your license and not be able to drive because of the medical condition.

Truthfully if the illness can come back I'd opt not to drive until you are cured of the problem, worse things could have happened then hitting a pole, so count you're blessings (you don't want to wake up seeing a bus shelter on top of your car and bodies strewn all over the road).

Thanks a lot for your answers D-BesT and v82slo,
I did not hit that pole at McCowan, my accident was back in winter.
I think I should not show the doctor's letter to avoid future problems with license suspension.
Now I am very careful while driving, I am healthy but still control myself.

Ok, so how can I explain the accident? The road was dry and the cop most likely recordered it. If I say I fall asleep - I will be guilty for sure.
Any other possible explanations?

consult a lawyer.

Is your ticket for careless driving fine, +6 points? If it is definatly get a lawyer. I have been in 2 situations, 1 accident and a separate time being falsely accused of driving without insurance both times I got off scott free (other than lawyer fees which were cheaper then fines plus insurance going up)

Contact a lawyer and fight the ticket. I had the same ticket as well and I got off best $300 I ever spent.

You haven't said what the charge is. If it is careless driving, you have a really good chance of fighting it without getting into your medical problems. It also gives you lots of outs to negotiate a lesser charge.

Um, you DONT Want to use "medical" as an excuse necesarly. Medical reasons are ground to remove your license!!

There are lots of ways NOT to be convicted of careless that dont necessarly mean Medical stuff.

Talk to a license paralegal, they can help , they know the courts...
Find one in your hood at imintrouble.ca and talk to some one real paralegal that actualy has experiance at a specific court.
