Appeals Process
 
Is there an appeals process for old tickets? I got a ticket about a year ago and just paid it, didn't go to court or anything, is there a way I can appeal it now to have the points reduced?

Yes you can, just head over to the traffic court-house and talk to the person at the counter about setting a date for appeal. When that date comes, be sure to talk to the crown prior, so you both are on the same page when in front of the Justice.

ya they didnt actually see me do anything, there was a little fender bender. Cops shouldnt have been called but the other party was a tight ass. I offered them $500 for 2 half inch scratches on their door, but they insisted on cops.

Official notice of appeal must be filed within 30 days of the trial decision to which you wish to appeal. So it's way too late. Besides, by paying the fine last year, you admitted guilt and don't qualify for an appeal. In other words, you can't change your mind after your plea of guilty is registered with the court.

Your now stuck with the points and some education. Next time you'll know to fight ANY and ALL tickets, immediately.

BTW, an appeal is not something for the casual defendant to toy with. Only a lawyer should handle an appeal.

Experience. Twice in my driving career I've had to pay off nearly $1500 worth of tickets. It was never too late for me.. Both times I had my tickets consolidated and reduced to a reasonable $400 and $700. YMMV :dunno:

Are you sure you had the same situation as Crazed? You plead guilty (by not disputing the charge), paid the fine, then (much later) filed an appeal and got money back?? Did you have a provincial judge hear your appeal? I'm just a tad confused here. Please detail the process if possible.

No, it went nothing like that lol. I had racked up a few traffic fines, and just let them sit for several months. Longer then I should have.. After they finally suspended my license, I went to the courthouse(Tannery Mall) and set up a trial date to dispute the fines. The date came, I talked to the crown and suggested I have my tickets consolidated into one(no points), and pay a reasonable fine in exchange. Went in front of the Justice, he agreed because the suggestion was coming from the Crown, which is how it usually works, and the tickets were dismissed. No points lost. This happened on two occasions.

Well, I wrote a pretty long write up about this subject. Do a search and if someone knows how to: post the link for my thread. To make a long story short...You can file for an extension of Appeal. :thumbsup:

I never plead guilty, I just paid the damn fine so I could renew insurance. Sad to say I forgot about it.

Ya, being the recipient of some 20 tickets +/- over 30 years, you don't know how much I wish I could reserect and fight them all. Now that I know how the system works (mainly due to the advent of the internet!) I am CERTAIN I could have beat most of my tickets.
