Apply for Stay of Proceedings if trial is 11months after getting ticket?
 
Hi all! I wonder if I could get everyone's input in this matter. I was charged with speeding and got a trial date that is 11 months after the day I got the ticket. I have tried to do a lot of reading on line (ticketcombat.com and fightyourtickets.ca). These sites seem to indicate that 10 months is the magic number for violation of the Charter - right to speedy trial, but reading some posts here on this forum made me question if it's really 10 months (the time between getting the ticket and the trial date). I plan to apply for Stay of Proceedings but I wonder if I should also request disclosure in case the prosecutor and JP quash my application for Stay of Proceedings. Any thoughts?

10 months HA, I've seen judges refuse 11b 18 months after the fact. But hey try it on the trial date.

Disclosure should be requested right after you get your trial date, otherwise theyll turn it around on you for slowing down proceedings.
