k i have a car accident that i need law + insurance advice and etc....

it happened in oshawa when i was going south on simcoe which is double lanes. i was driving at speed limit of 60 km/h as indicated down a slope and not far away i saw a buick drove out of his driveway of the sidehomes into the very LEFT lane, and i was ALWAYS driving on the right lane (lane beside curb) and then suddenly the old buick car changed lanes at the very last sec running at 20 km/h without signal and checking his blind spot. In my situiation, by the time the buick switch lane there was only 1 car space or so and therefore didn't break in time and rear ended the buick in the right corner of his rear bumper while he damaged my left front bumper. when the policeman came, he wrote a report and basically dismissed us both saying that we were both at fault but i was certainly NOT becus the buick driver didn't check his blindspot before he changed lanes at 20 km/h on a 60 zone.

can someone give me some advice on how to claim the buick's insurance or get him to pay for the damage done onto my car for his own careless driving.

i have concrete pictures that pretty much explains itself on what happened.

the best thing you can do is take him to small claims court. When you get there voice your opinion and the buick owner would do the same. Then its completely up to the judge to decide what happens.

The reason why the cop may have given u a ticket is because he prolly followed the "you werent driving according to road conditions" or some garbage like that. Anyways good luck with it

btw can you post some pictures on the forum if possible? just curious to see

I dunno how far you'd get in court with it cuz of the "no fault" insurance bullshit. Shitty situation, I've noticed A LOT of retarded driving lately. I miss my weekly trips to NH simply for the break of driving in Ontario!!
