careless driving!
 
Hey guys,

Need advise on what to do with a careless driving ticket I recieved a few weeks ago.
Anyone ever get one of these?

To make a long story short, I had a argument with my wife and I decided to leave my house and go to my parents house which is literally a 5 min drive down the street. The heat of the argument was so intense between my wife and I that she had actually called the cops on me (dont ask why, there was not kind of physical abuse or nothing, just a typical over reaction from a woman in the heat of the moment)

I did have some drinks in my approx 2 beers on a empty stomach and I had had another beer approx 2 hrs prior.

I pull up to my parents house and park on their driveway, as soon as I shut my car off my car door is flung open and I am pulled out of the car by a pissed off officer. And he is just going off on me about how Im a jackass, he smells the beer on me and tells me im loaded etc...

They made me do a breathalyzer test and it came back as "fail" I explained the situation to the officer after he calmed down and I leveled with him and told him I dont ever Drink and drive and I was just so heated and wanted to get away in the moment that I took off to come to my parents house.

I wasn't:
Driving in a stupid behaviour
Didn't damage anyone or any city Property.

The roads were completely empty, and I do have a witness to attest to this which is my brother in law as he was following me once he seen the cruiser following me apparently.

Officer claims I was speeding, but he had nothing to proove it, so I told him it wont stick and he didn't give me a ticket. He did claim however that he had to go 180km/h to catch up to me, and I replied back "im not concerned with how fast you had to drive your vehicle to catch up to me, I want to know how fast you have documented that I was going while you were in pursuit of me, and what device did you use to measure the speed I was going"

The conditions of the roads were wet as it was slightly raining. This is in a residential area with stoplights galore I dont even think a speed of 180km/h is attainable between lights.


So he ends up taking my license and suspending it for 3 days, and he slaps me with a careless driving ticket and tells me to smarten up.

Also on the ticket in the section that reads "Reduced code" its blank, so I guess he didn't reduce the ticket at all. It is for a total amount due of $325.


Any insight as to how I can fight this would be appreciated! :dunno:
