Court date for red light taffic ticket, which option to use?
 

I got a red light ticket back in July and I decided to go for a 1st attendance and plead to a lesser charge, but there was a strike. So I had no option but to set a court date. I had an out of province license at the time, now i have an Ontario one because I am a permanent resident.

So I am presented with following options:

1. Approach the prosecutor before the hearing and plead to a lesser charge then.

2. Hope the officer doesn't show up and hope it gets thrown out of court. . .its a she so I think she would me more on ball though.

3. Delay the date(don't know how), mine is set in June and hope it gets set later in July of 2010 so it will be a year . . .I heard it can be thrown out that way.

So which is best route to go? My main concern is my points on my license and keeping my insurance from going up.

You are going about it all wrong.

1: Request disclosure.

2: Apply for a stay.

3: Go to trial and see if the cop is there (he may be in another court room)

4: Approach the prosecutor and ask for a plea bargain if you want AND only if the cop is there.

5: Use R. v Rowan to argue your case for a stay if the prosecutor doesn't bite.

6. If you don't get full disclosure, then it's a whole different ball game.
