Disclosure - New Charter Ruling?
 
Is anyone aware of a new ruling that could be interpreted as excusing the provincial offenses office and/or crown attorney from disclosing evidence in Highway Traffic Act cases?

A friend of mine, during a first attendance meeting with the prosecutor in Peterborough, was told that their office is no longer required to provide disclosure in traffic act cases due to a recent court ruling. The friend was unable to recall the details the prosecutor provided.

I'm not able to find any information on this ruling, and in other reading, this would seem to be a basic violation of charter rights. If anyone's got any info on this, please share! Thanks.

Found nothing "Googlin". If it were true, I would think just about EVERY trial would involve at least one Continuance in order for a defendant to properly prepare after hearing the Crown's direct. Just doesn't sound right :confused:

Agreed.

We'll wait and see if anyone else has any info on this, and if not, I'll try and get some answers directly from the Peterborough prosecutors office.
