disobey official sign
 

I got a ticket for stopping in a no stopping zone. The ticket says "disobey official sign" I heard there are points with this ticket.
How do i find out? Its 85$ set fine 110$ total payable.
If there are no points witch amount do i pay?

It depends on how they charge you.

If you're charged under a city bylaw, it's no points and fewer dollars, $30, I think.

If you're charged with disobey legal sign under the HTA, then demerit points apply and the fine are higher.

Check the citation (ticket). If it has a Highway Traffic Act (HTA) reference on it, it was issued under the act. If there's no HTA reference, it's a bylaw infraction - no points.

Sorry to hijack this thread, but is it correct that all bylaw infractions don't carry any demerit point consequences? vs. HTA infractions all have demerit point consequences?

Bylaw tickets have no points or insurance consequences.

HTA tickets can have both.

There are several offences in which you can be charged either under the HTA or under local bylaws.

Actually there are NO points to disobeying an OFFICIAL sign (151(1) HTA), but there are 2 points for "disobeying a sign" (182(2) HTA). And with respect to bylaws there are no points, except for any offense involving a turn, in which case there are 2 points.

i was stop by OPP last night on front street for making a U-turn..he says that he stop me because theres no u-turn in front street..but i didn't see any u-turn sign when i make u-turn..he handed me a ticket of $85-110 payable.. for offense HTA-182-2. i understand theres a 2 point dimerits points on this right? if i will fight this am i gonna lost the points or i'm going to have it regardless..what is your recomendations..Joe.

Hello Joe, you're quite correct in pointing out that there needs to be specifically a sign prohibiting U-Turns before you can be convicted under section 182(2). Normally they'd charge you under the by-law for that offence, because under the HTA, it's only an offense to make a U-Turn under very specific and predictable circumstances: crest of a hill, bend in the road, or within a given distance from a pedestrian crossover, railway crossing, etc.
But yes, on conviction you're facing 2 demerit points, and yes, I'm in the business of preventing that. Feel free to visit www.mathesons.ca for more information, but do not under any circumstances, plead guilty. And never EVER let anyone persuade you to plead "guilty with an explanation"! That does not mean KINDA guilty, it is a gulty plea and full points will be assessed. If you want to address demerit points, you must ask for a trial under Option 3.

Convictions last for three years from the date of conviction, and the points last for TWO years from the OFFENCE date. Insurance companies, however can give weight to a conviction for up to 6 years.
