Goddam Harrassment Ticket

ok this is a mickey mouse ticket but it still irks me

Ok me and 2 buddies are in my car and im driving .... Im not speeding, Im not weaving in and out of traffic... Just heading to West Humber to pick up a friend... I see a cop cruiser in the lane next to me... So i dont pay much attention because im not doing anything wrong, my civic is not modified etc etc...

So he slows down till he's behind me and pulls into my lane... then the cherries come on

Im thinking what could I have possibly done... My plates are legit, no muffler noises, no smoking, and everyones wearing their belt... well except the guy in the rear, but the cop cant see that..

so the cop approaches the car and right away I ask him politely If i had done anything wrong.. He says "No but i noticed your plates are registered in ottawa".. and i say yeah cuz i live there... im in T.O for a couple of months till school starts again... so he says pull out the license, ownership, insurance... so im goin through my pocket looking for my wallet and realise i left it at home... stupid me, its my fault... so he goes easy on me and gives me just the "failing to surrender insurance card CAIA" ticket... which isnt so bad... BUT MY POINT IS WHY WAS I STOPPED.... YOU HAVE NO IDEA HOW PERFECT I WAS DRIVING EVEN WHEN I DIDNT SEE HIM YET

man i thought when i sold my rice-mobile that i would be rid of random police pullovers but nope... ongoing problem

maybe it was racial discrimination, maybe you were driving like a maniac and didn't know, who knows, either way unless you had anything on tape, it'd be hard to prove otherwise and now you're stuck with a minor fine ...

personally i've never been stopped for no reason, and i drive pretty fast even when the cops are around (fast as in 65 on a 60 when everyone else is going EXACTLY 60 or below) and i've never been stopped ... so you must have done something to attract his attention

trust me on this.. There was absolutely nothing done to attract his attention... i was doing pretty much the speed limit give or take 2km/h... no faster and no slower than anyone else.. and i was in one lane since I left my house.... I wasnt even gunning down on the pedal at all from stop lights when they turned green...

I dont know if it was racial... Im brown(Tamil), my two passengers are black... but at the same time, the cop was asian(chinese I think). So im not gonna really focus on that.

My theory is that it was a bunch of guys in a honda civic made it reason enough... but i was surprised either way... because there were plenty of cars out at this time... 3:45pm

I dont mind the fine... but the fact that it will count as a minor conviction and my insurance rates will go up does bother me

If the cop had no reason to pull u over then the ticket is bogus, cuz the guy had no reaosn to pull you over then he would never have found out you weren't carrying the right info/ID

Charter says:
9. Everyone has the right not to be arbitrarily detained or imprisoned.
Arrest or detention
10. Everyone has the right on arrest or detention
a) to be informed promptly of the reasons therefor;
b) to retain and instruct counsel without delay and to be informed of that right; and
c) to have the validity of the detention determined by way of habeas corpus and to be released if the detention is not lawful.

So pulling you over cuz you had Ottawa registered plates is crap

see i thought of that.. whether it is legal to pull me over for no reason... but then i considered spot checks... they are random and without cause... just to check for impaired drivers with no indication that the person is impaired in the first place... if they can do that, im pretty sure they can stop me for no reason

You seem to forget that police can stop any motor vehicle anytime to check to see if the person driving has a valid licence and insurance.

And by way of the HTA and CAIA it is an offence not to carry the required documents (driver's licence, registration/permit and a valid insurance card). These are very simply things to carry with you at all times.

Leave the ownership and insurance card (know when it expires) in your car. Who cares if someone steals the car with it in anyway, it won't make a difference to the thief if they get caught and you have reported the MV stolen anyway.

Since most people usually stop somewhere to buy something, always have your wallet which would contain your licence....there all 3 documents would have been there and you would have been on your way.
*******
I've been stopped before for just the simply checks of my documents and looking at it, I really appreciate it. I would rather know police are checking drivers and vehicles....last thing would be to be in an accident and the other person not be licenced or no insurance, or worse yet be a pedestrian and be run over by someone without insurance or unlicenced.

I'd rather be stopped and checked (I have my documents), makes me feel secure police are in the area, checking people in my area. The thefts in our local area have also gone down with these increased checks.
**********
Bottom line is it is easy to keep all documents with you, having a valid driving licence is a priviledge NOT a right.

bla bla bla... if you just read the post that i made before yours... you'll see that i know that police can stop me at random... and if you read the first post...you'll see that i accepted that it was my mistake not to carry the documents.. im not trying to escape accountability so your long *** boring essay doesnt do all

go waste your time with someone else..

I was wondering why I was specifically targeted nothing more, becaues I know people who never get stopped at random no matter how many police they pass by.. it seems to happen to me often

perhaps I should be happy like you that every other time I leave my house Im stopped wasting my time... Do you think that its fair and just that Im not able to move about freely in this city and have to submit to these pullovers.

You may appreciate it, I DONT. I dont get tickets everytime but thats not the friggen point.

Lets say im going to work or an exam... and I get pulled over.. some police take their time... I should be happy that ill be late right? Or maybe you might suggest that I should factor in pullover time before I even leave my house

im have no criminal record, never ticketed for racing or anything, car not modified, my only question is why me? AND IF YOU CANT ANSWER THAT QUESTION MOOSEBOY, I DONT CARE WHAT ELSE YOU HAVE TO SAY.

I read all the posts.
The pro victim ones .
The pro cop ones.
What we really need to see now is the cops veiw . Yes , his veiw . I would like to see him post on here and explain what the infetissimal (sp) detail was that triggered him to pull you over.
What was it about your car , passengers, the colour of the sky, the direction of the wind, the urgency to have a bowel movement, that made him think. HMMMM, I better pull this guy over. Rather than any of the other cars in his veiw that day.??.
Guess what 10 bucks says protecting society may be the answer of choice to defend/explain his actions , but its all gonna sound like B/S..77.

according to him when i asked. the reason he pulled me over is because my plates are not from around here.. they're from ottawa

which makes me wonder why he even felt the need to run the plates while he was driving...

im not gonna complain about this further... i guess it happens... i just wish it friggen wouldnt.

Sometimes, these "insurance checks" are based on a cops "hunch". There is no justification for running plates, only person that can tell you is the cop himself. IF you want to find out, you can go follow:

<moose> had a good reply

Kingstom is running a pilot project where every time cop pulls over someone, has to document: reason, race, outcome, etc. The findings will come out this spring. It would be interesting to see the results.

The problem I see is, alot of people complaint and not many are proactive.

Pro active about what? You get pulled over and don't have documents and you get a ticket. Some cops would give you one while some wouldn't. That's why I NEVER ask why I got pulled over because they don't need a reason.

here's a thought, maybe if I was a 33-year old caucasian male driving a volvo I could avoid these incidents.. as much as "certain" people would like to think that the police are fair and just... they cant disagree with that..

you all know as much as I know... that a brown guy with a bunch of black guys in a civic will get stopped any day over an older caucasion guy driving any other car... what a socially equal society I live in... someone used the term hunch, hmm... its a fairly specifically targeted hunch... cuz me and my friends must have criminal records.. and of course we have little baggies of weed on us...also probably been arrested before... oh yea and I was probably high or otherwise impaired...I SHOULD JUST TAKE MY LUMPS AND LIVE WITH IT RIGHT? WRONG, IVE ALREADY SENT NUMEROUS EMAILS TO DIFFERENT DEPARTMENTS OF THE POLICE IN HOPES OF GETTING A RESPONS. Even if nothing comes of it, Ill feel better knowing that I actually put forth an effort and didnt sit on it. I wouldnt care if this happened once or twice as thats understandable...

Oh yea and I shouldve mentioned that Ive had dealings with this particular officer before... One night at around 11pm while me and some friends were on my driveway, 2 police cruiser out of nowhere just beamed those bright beacon lights on use blinding us.. all got out of their cars and started walking around our cars... 1 of the 3 officers was the same cop that pulled me over on friday...of course they asked us all for identification and bla bla bla... FUNNY HOW IM SUBJECT TO THIS IN MY OWN NEIGHBOURHOOD....

If those of you who dont agree with me had to deal with this day after day, you would feel the same... its not as simple as drive properly and you wont have problems... lol yeah i wish

Well there you give some background. Kinda sucks...would ya feel the same if you were speeding and got stopped and got the ticket? Or would it still be an issue of race?
