got a ticket for having license plate inside window

so my cars been stored all winter, it was a nice day outside and decided to take it for a drive downtown. got pulled over and i got a $110 ticket for having my license plate inside the window of my car, any way i can fight this ticket? or should i just pay it.. any help is appreciated

Bookm 03-15-2007 10:36 AM

What section of the HTA were you charges under (written on citation)?

kwikshifter 03-15-2007 11:56 AM

The plate is to be displayed mounted to the front of the car. Some officers will write a ticket for it in the window...some will just warn you. You got the wrong one. :nono:

It's easier just to pay it, and put the plate on the front.

BTW, if it was there for looks, example you think it looks dumb on the bumper, it looks a million times worse in the window.

whitedr4gon 03-21-2007 11:13 AM

no i didnt put it on the window for looks, it was winter and i was working on the car so i took everything off it.

tonight i will get the ticket and tell you the exact HTA i was charged for. but all and all im going to pay it. a buddy of mine said if i went the next day in the morning to the police station where i was ticketed, and told them my situation thats the only possible way i might have been let off, other than that i gotta pay

kwikshifter 03-21-2007 05:46 PM

They may have let you off at the station.

It's one of 'those' areas that technically it's against the HTA, but it's a mean officer who writes you up without a warning.

whitedr4gon 03-22-2007 12:10 AM

Highway Traffic Act: 7 (1) (b) (i)
Signature of issueing provincial offences officer: he signed in pencil, then overtop in pen.

Comment: Drive motor vehicle plate improperly displayed

can i go to court and say i wasn't warned? or will nothing work, jus pay it?

They don't have to warn you, and don't have to give you time to fix it.

bingo

Bookm 03-22-2007 05:11 PM

7. (1) No person shall drive a motor vehicle on a highway unless,

(a) there exists a currently validated permit for the vehicle;

(b) there are displayed on the vehicle, in the prescribed manner,

(i) number plates issued in accordance with the regulations showing the number of the permit issued for the vehicle, or

I can't find the "Prescribed Manner" but, Ya, I think you're hosed. I got stopped once because the LEO couldn't see my trailer plate mounted in the factory position (on axle... snowmobile trailer). But no ticket, just told to remount rearward.

If I were you, I'd still contest it and hope the cop doesn't show. I beat a trivial ticket that way once (couldn't find my insurance slip until AFTER the ticket was written). If he does show, change your plea to Guilty w/explanation and try explaining to the JP that the plate COULD be seen, so at least your intentions were good. He may drop the fine (possibly in 1/2).

Remember, your insurance company will likely raise your rates over this, even though there is no added risk to them.

whitedr4gon 03-23-2007 01:06 AM

Thats what ill do, thanks for all the help

R/T kota 03-23-2007 06:56 AM

put the plate back on the front. Go to a mechanic and say have him write you something saying that he repaired your licence plate bracket.
Take that to the JOP and do the Guilty with explanation.
Chances are he will drop the charge.

:headbang: The Fiero guys bring a note from the GM dealer explaining that the 'rare' front licence plate holder is no longer avaialable. Tell them you are getting a used one, and sometimes it works. Doesn't hurt to try.

I'd just go in and explain you were just moving it from winter storage and didn't realize that it had to be mounted for a short trip to the mechanic. (since that's where a temp permits has to be displayed). Not everyone can be as big a dork as the cop who wrote you up. :dunno:

wolfpacinc 03-24-2007 04:34 PM

this ticket for improper display of front license plate can affect ur insurance for real??? that must be a joke i duno ...

95sohcturbo 03-24-2007 10:15 PM

ticket

always fight it because half the time the cop does not show up to court

i beleive insurance counts all hat stuff its a minor offence i think they classify it as

whitedr4gon 03-26-2007 11:16 PM

yeah i really hope it wont affect my insurance, i doubt it

toofast 03-27-2007 04:01 AM

ticket

just pay the ticket i got the same ticket and it did not affect my insurance at all just the cop was being a d*ck

Mak-B 03-27-2007 05:13 AM

Its not a moving violation, will not affect your insurance. Its just a tax revenue fine!

3nidapooh 03-27-2007 10:17 AM

i got a ticket cause my screws came loose and i had no tools with me coming from hamilton so i had to take off the plate from the bumper but go to court and plead guilty with an explanation and they will either lessen the fine or drop all charges. BTW i got mine dropped but i still had the front plate visable on the bumper but the rear was in my back window. GoodLuck!

Bookm 03-27-2007 12:46 PM

Most insurance companies will allow one minor ticket (within 3 years). I had one speeding ticket and insurance didn't go up. 1-1/2 years later, I got a "fail to show insurance slip" (non-moving violation). My insurance DOUBLED! Different companies have different policies, so I wouldn't believe that insurers ignore non-moving violations. In my experience, it's the NUMBER of tickets that matters.

whitedr4gon 03-27-2007 04:01 PM

last august i got a speeding ticket and failure to show insurance ticket, and i got it dropped to a minor ticket, and got the insurance ticket removed.

so if i dont fight this ticket, will my insurance rates go up?

Unfortunately, at least here in Durham, cops are now sent on work time. So the old hope he don't show rules doesn't apply much.

Because each company has their own rules, you should just call your agent and ask him.

Exactly...pay the ticket and mount the plate.

thatkidhugo 04-03-2007 11:58 AM

sucks man, cops can def. be homos

89daytona 04-03-2007 09:41 PM

Got that ticket from a female cop, she was definatly feeling high and mighty. I told her it was there because it fell off earlier in the day, went to get a court date, currently waiting for it. Going to bring pic with it mounted whenever that court date is, and hopefully it gets thrown out.

Mazdazoom 04-04-2007 02:55 AM

This ticket a MINOR one and Will not affect ur insurance all. ( u can call ur insurance company and confirm .. but im 99% sure of this.)

You can easily fight this ticket and win ... LIKE another member suggested go to a mechanic and tell him to write u up a bill for a front licence mounting kit or something along those lines.

or u can even come up with other believable excuses .. The screws holding the plate broke ( rusted over winter ) and the license plate was hanging by 1 screw .. so instead of it dangling on the highway u decided ( for safety purposes) to keep it inside the car ( still clearly visible ) until u got it to a mechanics shop.

Fight it for sure , put it in court.

89daytona 04-04-2007 09:29 AM

very, very good ideas, lol thanks man, these will help me whenever my trial comes up

wolfpacinc 04-19-2007 10:54 AM

89daytona 04-19-2007 08:32 PM

my ticket was 120, mabe she wrote it wrong and will get thrown out... *crosses fingers *..... 2 blonde chicks... pssht.

stangboy11 04-21-2007 05:57 PM

I got the same issue with my car, it's from BC and it doesn't have a license plate bracket. Unfortunately, I'm hoping to find one soon cause I drove the car with the license plate in the window.

In any case it is illegal to drive with no plate out front, and I'm certain that it will not effect your insurance. Nevertheless, take it to court, you have nothing to lose, you may save yourself the 110 bucks.
