Help Court On Tuesday
 
ok i am going to court for a small mishap on halwoeen,

Mischief Under $5,000

all i got was a ticket, i got printed and photo'd, i tired to make an appointment with crown, but no appopintment, i am going to court on tuesday for the first time, can i request disclosure @ in court???

set a trial date, state you havent had time to get a lawyer and you need one, state you havent received disclosure and request it.

First of all it wasn't a ticket you got, it was probably an appearance notice. Don't confuse the two, they are world's apart. For one thing a ticket is issued for offences under a provincial offences act such as the HTA, and an appearance notice is issued for criminal offences. Thats what mischief under is, a criminal offence. You are probably aware of all that, but some on this board may not.
You don't need to request disclosure when it comes to criminal court because it is automatically provided. If your going to court for the first time on Tuesday that will be your "first appearance". The reason you were not allowed an appointment with the crown is because it would be pointless. The crown can not make a deal with you for criminal offences like they can with provincial matters.
In regards to a lawyer, you have to make up your mind before Tues if your going to hire one. They will ask you that. They will also ask why you have not hired one already. After all, you've had since halloween right?
