Hm 2 gay tickets this weekend.

okay this edit was posted cause my bro posted this the first time. i dint tell him the whole story but just enough.
i was foolig around in a parking lot and i just did like 3 spins. after i was like spinning out i drive off cause i saw a cop. Later opulls me over. i said i was turning and i hit some sand and my car spun out(i was drifting but i made a good story) and then got an uneccesary road noise ticket. w/e im gonna fight it cause i dont need this . anyway the other one is failure to show insurance. (i didn't have it at the time) what can i d o to fight this second one. its pretty gay.

Blacky 11-07-2005 04:22 PM

What can you do to fight a fail to have insurance card charge? Well, you could hope there is a fatal error on the ticket, you could choose to have a trial and hope the cop dosn't show, or hope for a miracle. Aside from that...nothing.

All sarcasm aside, this is such a minor offence that you can't even barter with the Crown. Because there is no lesser offence. The fine proves that, what was it $55 or so? Your probably aware but there is no points associated with this charge.

Blacky's right. There's no way to fight it unless there's an error on the ticket. The Compulsary Automobile Insurance Act provides no exceptions for failure to produce the insurance card on request.

okay 55 not bad but how about the other one?

Blacky 11-09-2005 10:19 AM

I'm going to have to give you the same advice about the first ticket too. Because, again there is'nt much to barter with here.

But I think you should consider yourself lucky on this one. The cop obviously knows it was you making the excessive noise, but what else does he know? What else did he see? Maybe he also knows you were drifting?

There are several charges that may apply here. How about "leave roadway not in safety", "fail to drive in marked lane", and perhaps even "Careless driving". Yes, careless driving which carries 6 demerit points! You see, when your vehicle is spinning, especially when its does 3 rotations, your not in control. You may argue that point, but I can promise you that the court will not see it that way.

My point is he dosn't charge you with any of those serious offences. Instead he charges you with a minor offence which has no demerit points, and again a minimal fine.

Like I said you should consider yourself lucky over this one.

she didnt see cause my friend saw her come from beind a bunch of cars and this means that she just heard and drove to the sound. But w/ im still gonna pay but i will explain that i don't got money and hopefulyl they will give me an extension.

Bandit007 11-09-2005 01:37 PM

These are both bogus tickets. THe no insurance card is no biggy. If you did have insurance at the time, just show up with the card and get a letter from your insurance company stating that you did have insurance at the time. Now for the unnecessary noice ticket. It doesn't hold up in court. The reason being, you were in a public area and can only be charged if there was a complaint about the noise. But, I will say this though, the cop has to state what the noise was, how loud it was and the area you were in. Public park lots are usually exempt from such noise laws unless its between the hours of 11pm and 7 am in the morning. About 90% of the time, if you stand up and tell the judge the truth about the incident and say something like it was inmature of you to do such behaviour, they may reduce the charge and fine or throw it out completely. It depends if the judge is fair, in a good mood and they believe your story.

Blacky 11-09-2005 04:10 PM

Cryoslash, yes if you explain that you're short on cash they will accomodate you. In fact they will probably ask you how much time you need, but no guarentee that's what the JP will give you.
As far as Bandit's post, " just show up with the card and get a letter from your insurance company stating that you did have insurance at the time". Your confusing being charged with operating a motor vehicle without insurance and fail to produce insurance card. If Cryo had been charged with operating with no insurance your advice would be valid. In regards to the noise between 11-7 am, your referring to noise by-laws. They can vary from city to city. In fact in my city there is no time limit. You make excessive noise at any time, its an offence. But to get back to your point, thats a by-law we are talking about a charge laid under a provincial statute. Another point to clarify, you say that you can only be charged if there is a public complaint? Not so I'm afraid. After all the officer is a member of public, right? But you are right about the officer having to say what the noise was, how loud it was, and where the offence took place.

SirChirpAlot 11-14-2005 09:00 AM

If u had insurance and failed to show the slip say the cop didn;t give u time to get it and you were uneasy and you have never been pulled over b4.
If u didn't have insurance then oh well.

Noise how many DBs what was it if for? Tires Muffler What. Wa sit just Noise ticket nothing else?

Ether way there dumb tickets fight it and hope cop dont show is it do ask for another court date u feel ill

StealthZ 01-08-2006 10:22 PM

you made an foo of yourself in a parking lot, then drove without insurance and you want help fighting that? pay the tickets and accept the outcome.

you were "drifting" in a parking lot and made up a story that you hit sand. k i got that. CLEARLY that wasnt your fault. then, you dont keep insurance on you and failed to provide proof of it, so u were given a ticket. hmmm. think i covered up everything, right?

instead of asking for help on how to fight your tickets, you could have done the obvious thing and went to the cop station the next day and provided proof of insurance. also, instead of makin a bs story next time, be honest with the cop, he/she probably isnt an idiot, and can tell what you were doing. it might have got you off with a warning.

Daley 01-10-2006 10:35 PM

^^ agreed.

This guy is getting mad at you (StealthZ) because he made a dumbass move and wants to weasel his way out.

Deal with the bs, you certainly deserve more then what you got, so consider yourself lucky.

improper muffler or noise polution tickets dont need to be metred.
mufflers doesnt matter. Police officers dont need to check.

That ticket is at the discretion of the officer, good luck fighting it.

AMD 01-16-2006 04:39 PM

for the no insurance slip you should of went the next day to the cop station showed them the slip and make something up like u forogt your wallet at home. usally if u tell them that from the begining they wait for someone to bring it to you, or next day u show them. for the unnessary noise ticket like i said even though its not for muffler get a bill of sale that you replaced something with your muffler. easiest way to get out of them freely. If did have insurance for that date and u could show the prove of it in court it will get dropped also.

k, heres some advice:

1) keep your license, insurance card, and registration in your car at all times.

2) dont do burn outs in public parking lots. i realize that your 17 and you just finished watching fast and the furious on tv and that your moms civic is a drift machine but resist the temptation.

3) we all get tickets. take em as a lesson. aparently you are not learning from this one.

and if you did read my post, i did give you advice.

My mom drives a van, i own a supra. watching the fast and furious is totally unrelated as many thousands of other people have seen it so i do not understand why would you post something like that. And Daley seriously i just think you need some love from your parents :knock_tee

You're the rocket scientist that got pulled over for driving like a 12 yr old. Perhaps some drivers ed and some schooling might help you.

I will not allow Daley to lick your balls... :nono:

The right advise is to take. Sometimes its not about fighting the ticket. Once in a while your goose gets cooked, legit.

well I might be asking a stupid question here that was answered before, but did you not tell the cop that you had insurance, and that he could easily check on his computer that you are infact regested owner and have insurance since the car did have the right sticker on it. And if the officer couldn't all you had to do was show up with it at the cop station the next day and show them.

thats not how it works. you need proof yourself ie the card. and the smart thing to do in a situation like this is the next day to go with the card and get the ticket revoked and not to fight it. take the blame, say you made a mistake and dont bs them, theyve heard it all before.

Exactly.

And yes - I need school. You know nothing about what I do and where I work. No matter what I say will change your view - so please just take the tickets like you should. You got them - you were guilty. Be a man, not a kid.

CryoSLASH 01-19-2006 07:02 PM

heh okay next tiem you get a ticket then id like to see you just take them instead of trying to fight it. I bet everybody here would do the same thing, even you. Dumbass.

Don't you have homework to do for your gr 12 english class?

haha, another gangster!!

Thanks for coming out - why do you think I said learn from people who have done this before. Where did I say I never did anything dumb?

back to the trailerpark for you.. :appl:

Daley 01-30-2006 10:25 PM

And yes, 90% of the tickets I got I faced and paid the fines. The other 10% had LEGIT reasons that I didn't have what I needed - like my dad having a heart attack, and having to be at the hospital for him, rather then going to the ministry to get my license back THAT day.
