I win. (by default.)

Finished my last court date this past week. (warning: long read. good ending.)

All started last June, downtown @ Bloor + Jarvis on a Saturday. As I followed a Police officer directing traffic southbound, I was surprised to see him start chasing after me on foot as I rolled slowly down the street. Pulled over, and put on my ass-kissing lips.

To no avail - he lit right into me, evidently pissed to the eyes about nothing in particular.

"what's the matter officer?"

"Your car is illegal and unsafe, and I'm taking the plates off it."

Oh no you didn't.

but that's just what he proceeded to do. as I walked around to the front of my car with him asking what was 'illegal' about it, he reaches down and rips the plate clear off my bumper, bending it in half and scratching the paint all to hell. I freaked out and shoved him onto the sidewalk, and he tripped and fell on his ass. He gets up, runs at me and throws me into traffic on Jarvis! we went back and forth for another minute or so while I demanded my ticket (to know what he was charging me with), and he cautioned me about being charged for assaulting an officer.

at which point, he tells me "I don't have any more tickets. you don't get one." and starts walking back to his motorcycle with my busted assed front (and by now) rear plate. I went at him again as he put the plates in his bike carrier, and as he went to cuff me, my girlfriend grabbed my plates and ran with them. he quickly chased her down (pretty impressive for an old ****er.) and cuffed her too.

we stood around bitching at him and otherwise making a scene in the street for a half hour or so, until he took the cuffs off and left, without saying another word. no ticket, no reason given for taking my plates... nothing.

completely pissed off, I get on the phone with just about every Police Supervisor in the city. I must have annoyed somebody out there, because they finally sent one an hour later. Sgt. Perreault (this guy is awesome good ) helped me out. - agrees with me that my car is not, nor even appears - to be illegal or unsafe. called over to Traffic services (53 div?) and saved my plates from being submitted to the ministry. *if that happened, I'd have had to buy new plates before I could drive the car again.* he works out a deal with the cop, that if I can get the car safetied and show him the papers in 48 hours I can get my plates back. sweet.

Unfortunately, he couldn't do anything to help the current situation of no plates, and I had to get a flatbed to take the pick up my car and take it to crappy tire @ Church + Yonge. $150 for three blocks, ****. most expensive ride ever.

wait two days, and get the car safetied. $100. + $200 for the lost day of work, cuz I didn't live in Toronto @ the time.

took my safety papers down and just about shoved them right up the pigs' ass. at first he whines about it not being safetied properly, but a call to Sgt. Perreault shuts his bitchy lip in a hurry. he goes to the back, and comes back with ONE plate, and my long lost ticket, which is now irrelevant. I ask for my other plate, and he says he doesn't know where it is. I ask why he's giving me a ticket now, and says "we'll deal with that in court." ****er.

anyways. over the next week and a half, I get pulled over and ticketed twice for having no license plate on the front, which I told the officers "some ****ing pig stole it in Toronto." (except not as colourful words.) didn't matter how much I sugar coated it, they still shafted me. I played the stubborn for another few weeks before I finally swallowed my pride and bought a new front plate. Fortunately, both judges of those tickets took exceptional delight in my story, and dropped both tickets.

fast forward ahead 9 months and two court dates, and that brings me to last week.

all prepped up with what was a bulletproof 2 part defence, I went in to court ready to spit in the ****ers' face. in addition to my safety sheet/receipt, I also had associated myself with the HTA. section 84 (6) says "blah blah blah a person is not guilty of an offence if the officer does not serve notice in the form of a ticket/citation." basically, he didn't give me a the day it happened, only after the fact (and despite my safety sheets.)

annnnnnnnnnnnnnnnnnnnd.

"how do you plead?"

"not guilty."

"well, that's how it's gonna stay, cuz the officer retired. have a good day."

"..!!."

****er. I hate (some) cops.

StealthZ 03-29-2006 02:41 AM

shoving the cop...not too bright
ur gf taking the plates and running...not too bright

overall you werent at fault, and all of this could have been avoided if, by my educated guess by reading your post, you werent such a dick to the cop. i doubt the story played out exactly like u said, ie. ripping ur plates off yadda yadda, but whatever.
and no, hecant give u a ticket after the fact, so i would have just left and laughed about that one.

what are you, new?

my actions were a response to his ignorance, not the basis of his decision to be a prick.

people who drive modded cars don't get harrassed because of attitudes like this. They get harrassed because the majority of them drive like ****ing idiots.

unless he wrote everything down and also mentioned the speeding, he cant just pull it out of thin air. that can be fought and won.

You should have demanded compensation for the damaged bumper and the cost of the safety.

To let that blow over like that you would be a fool, your case is bullet proof. Hire a lawyer.
