im a ing moron. need advice please!

i got nailed speeding on friday. 148km/h in an 80km/h zone. officer dropped the ticket to 49km/h over. i can barely afford the ticket let alone my insurance afterwords. now i know i deserve what i get but driving is a very important part of my life. believe me, if i get a second chance out of this im not going to make the same mistake again. do i have any chance at getting it reduced further? any advice is appreciated, thanks guys.

If the original speed is not written on the ticket, or it is not marked reduced in some way, your chances are good to get this reduced.

Go to the courthouse and file a request for disclosure. Just ask at the provincial offenses desk for a form for this, and fill it out. This will get you a copy of the officers notes.

If the officer doesn't write down the original speed in his notes, you have an excellent chance of getting this reduced further.

you did nothing wrong , what these idiots need to do is train the dumbs to drive , take away the AWD's from the 40 year old women and raise the speed limit to a sugested 130 kmph like in more advanced places

Not quite. Police never write the original speed on the face of the ticket. The reason for this is because there is an "approved wording" that must be followed. That being "speeding X kmh in a posted(optional) Y kmh zone". In other words, there is no opportunity to explain the original speed. The officer dosnt even have to write the original speed on the back of the ticket. Some officers write their notes on the back but others put it in their notebooks. (But the original speed will be indicated somewhere when disclosure is provided)

Further, usually a reduced ticket will have code R near the bottom right hand corner to indicate that it was reduced. But if the officer neglected to enter that, it dosnt invalidate the ticket.

But to answer the originators question about getting it further reduced, I think it might be possible but it depends. It depends on previous convictions, and the the circumstances of the event. Was this a result of a traffic complaint? Were there other tickets involved? Did he give you any warnings about other infractions? If any of this is true it will be in the disclosure. But remember disclosure is not just for your benefit, the crown attorney reads it all too - before he makes a decision about a further reduction!

Not true. Officers routinely mark the original speed in blank areas of the ticket, or, as we both pointed out, with an 'R' or other marking indicating it is reduced.

Hmmm okay, if some agencies are doing this I'm not aware of it. I will even assume that the court in this area dosn't have a problem with it, or at the very least that it has never been challenged in court. But just out of curiosity can you tell me where this is happening?

you got nothing to loose thogh

take it to court ... and before the trial you or your rep will talk to the cop . The cop will offer another discount , or tell you to off cuz he'll tell the actual speed . At this point you can beg him some more . If he decides to be an you can fight the ticket or withdraw . If you fight you have a 10% chance of winning .

You also have a chance of the ticket going back up to the original pre-discount level.

Exactly , if you fight it , with him telling you not to fight it , that is a very strong chance .

You can try talking to the cop, but they will probably refer you to the crown attorney. If anyone has had a first appearance hearing and had something reduced you now what I'm talking about. For those that don't know, the officer is not required to attend a first appearance!

As far as the 10% goes, if thats your success rate in court it dosnt mean it applies to everyone.

i've been to court many times and saw that the job of the paralegals is only to convince their client to take what the crown is offering , telling them that they got no chance if they go to an actual trial ...

this way everybody gets a cut , and it's all legal and simple

Your insurance grows a bit , the "lawyer" gets his cut and payes takes , the cop gets his money for showing up in court , the judge gets payed for sitting down , the prosecutor gets a job to do , they all pay taxes ...

Call Redline Legal Services (416) charged

www.charged.ca

they've never ripped me off, complete wins, not just reduced fines. They always go to trial. Read the case studies for yourself, they're the best.

Just to let you know, i had a similar experience just this month. I got 170 in 100 zone and chose x-copper to fight it for me. I was trully ripped off. they charged me 600$ for showing up at first attendance, and droping it to 149 at 100 zone WIHTOUT seeing the evidence that cop supposedly had against me.
