Lane change - not in safety... demerits?

Has anyone ever tired to fight a lane change - not in safety ticket?

A friend of mine recently got one and its a $180 fine...
anyone know if there is any demerit points attached to this one?

Story is.. my friend was pulled over for cutting a cop off apparently..
my friend doesn't think so
either way.. there was a slow moving vehicle ahead (salt truck weaving on the highway) with flashing blue lights.. my friend was doing speed limit.. and tried to pass the truck when the cop pulled him over
so obviously the cop was flying since my friend supposedly cut him off.. and should not have been under the circumstances

will this hold up in court?
and agian.. are there any demerit points attached to this offence?

Thanks!

i got a ticket for that already except i was coming out of a side street and the cop was on the outside lane and changed to where i was and pulled me over saying that i cut him off. Trust me i went to court and fought it myself and won.

i actually got one like this tonite
except my ticket was for $110
any idea on demerit points for it?

Kuztom Freak 03-01-2007 12:58 AM

lange change not in safety is 2 demerit points, if it causes an actual accident/collision its 3 points.

fight every ticket even if they dont involve demerit points cuz insurance companys also view getting demeritless tickets as bad/unsafe/dumb driving and may use it as an excuse to raise yer premiums

I havnt got a ticket since 1992 - doesnt the ticket say on it how many demerit points?

ya I was like 18yrs old and was turning into a gas station and some dumb fukk T-boned my passenger side on a 45degree angle, it just flash snowed too. we called the cops, 40 mins later they showed up, a trucker who was driving behind me saw the whole thing, told the cop that the guy who hit me flew by him, cut him off, then tried to make a right turn and hit me doing 75kms (as per insurance adjusters estimate due to damage done). If the guy who hit me didnt hit me, he would have never made the turn (due to his speed) and slid across that corner and plowed into someone else. He hit me soo hard as I was turnin into the gas station that I almost hit the pumps.

So guess who guets the ticket - ME - wtf????? + 3 demerit points, the ticket was lane change not in safety wtf??? cuz the snow made my back end slide out a bit (drifted out) is why I got T-boned, cop thought I cut across a couple lanes infront of this guy, why the fukk would I do that??? for gas??? what about the truckers statement - duh

That was in 1992 and my premium hit something like $4,700.00 a year and took bout 3-4 yrs before it got down to something like $1,500yr

That was on a 2dr 1987 K-car based car, never mind when I drove my Camaro

I usually only get pulled over for stupid shite like expired tags (to lazy to stick em on the car), failure to produce license, really mild shtuff but usually while driving other ppl's cars. Ya I've been fortunate - I scan the roads all over as I drive cuz I have a tendency to drive 120 -140, keep an eye out to see if anyones trying to pace me, etc....

I got pulled over several times a day while driving the Camaro in my teen to eary 20's

Now my rates are [get ready to get pissed at me] are aprox $100-$110 a month, but Im also 33, and I can insure my Camaro for hobbie use for like $400 a yr (some restriction of course)

wow.. that suck...
were u able to fight it off?

for these lane change not in safety tickets.. is there a way to get them reduced? at least eliminate the demerit points?
for instance.. will there be a chance for the charge to be reduced to perhaps one that does not carry demerit points?

Kuztom Freak 03-02-2007 09:25 AM

Naw I went to court and lost - thats why I said my insurance went up to $4,700.00 (that doesnt seem much now, but 15 yrs ago it was a lot)

as far as I know - you/judge cannot reduce demerit points in court, only fines can be reduced in dollar value, so its either win the case and dont get demerit points added or lose/dont trial it and get 2 points+fines+higher insurance

I would absoloutly fight it

will there be a chance for the charge to be reduced to perhaps one that does not carry demerit points?
I have lil clue on this one, but you can be charged with a new or added offence up to I think 90 days by an officer, so if yer court date is many months away a cop cannot then charge you with some different offence, so its not like premeditated murder being reduced to aggravated assault. I say ask a X-Copper for that

xtremekaz 03-03-2007 01:50 AM

yup just found out its 2 demerit points and $110 for me
im definitely gonna fight it whats the worse that can happen... i just would have to eat the fine/points and pay the insurance
i have a clean record so we will see what happens ( 1 ticket was wiped completely on the spot, 18 over the limit reduced to no points and $50)
i think what they are doing now is u dont have to wait a year till u get a court date
it says on the back of the ticket if its during the 15 day period u show up to court ( a time u booked) between certain hours and the days and its a much quicker procedure
so we will see
wish me luck

supermikeboi 05-22-2008 10:43 AM

yeah thats a bs ticket. i got one for changing lanes without signaling in a residential area. going to fight the ticket and see how things go. 2 demerit points and a set fine of $110.00
