little accident
as im driving on lakeshore some dumm blond doesnt look left when making a right turn of a street on to lakeshore, and im driving on the right side of the road so i try to dodge her car and as i do that i go a bit in to the left side of the road thats still going east and i hit the handle of some guys rear door with my side mirror, i hit a bit of it and made a small dent in his door right after the handle. the woman then drives meside me and shows me the hand gesture for "learn how to drive" and pulls away and me being in a box terrcel ther i couldnt even get close enogh to get her plates. the other guy stoped and i pulled behind him telling him what happened. now my questions are do i have to pay for his damage or what? is there a way to prove that it was the womans fault and i had to swerve away becasue of her? and if i have no choice and have to pay for the guys damage, how much will it cost to replace the door handle and fix the little dent thats about 1 inch long and scratched? and i didnt call the cops, can i still call them after the accident and me leaving the "scene of accident" and tell them what happned and if i call them will my insurance go up?

i'm not sure how much a door handle would cost, but it's most likely not enough to warrent going through insurance (on both sides). if you make a claim, obviously your insurance will go up (since you're at fault in this case).
best bet would be to just pay for whatever damage you caused the other party and not involve your insurance. unless somehow a door handle costs more than $1000 or the other party cons you into replacing the entire door, you won't need to involve the police, collision centre or your insurance.

You have no way to identify the person who supposedly turned out in front of you forcing you out of your lane, so who else is left to pay for the damage but you?

first of all a witness in an accident can not be in the car of any of the people involved with the incident. you got screwed bro and you will have to pay out of your pocket to pay for the guys car you damaged. wat i dont understand is how if she was in front of you could you or your friend not make out her plates.

she was truning and if i decided to hit her i would of hit the side of her car so i moved and then she was behind me cuz i was aobioulsy going faster then her and then she just drove away and i stopped behind the guy that i side swiped. and yah i had the choice to just hit her and not cared because i was in a tarcell and she was in a mazda so i dont realy care what happens to my box.

IF you have the right of way and you hit the vehicle thats wrong but you decided not to swerve cause of watever reason. Could you be charged and or still found partially at fault for "not sharing the road" ??

It kind of makes me wonder just how fast you were going that a simple low-speed avoidance maneuver should put you in contact with oncoming traffic on the other side of the road.

i didnt go in to on coming traffic i was driving 50 in the right lane of the east bound side and when i tried to avoind the woman i merged a bit in to the left side which is also going east bound.

Simple answer...
You avoid 1 collision and cause another....YOUR PROBLEM.
In these situations Shitty as it is for your own benefit grin and bear it and hit whomever is the original cause of the problem in this cause the lady turning.
Insurance company's in this circumstance would penalize you because you had the choice hit whos at fault or try another scenario which didnt work out in your favour they see you now as no better than the woman who turned and she walks away scot free and you take the 100% hit.
If you were to avoid an accident and did damage to your vehicle such as bang a curb break lets say $1000 worth of damage to your vehicle. The guy that swirved at you stops wait for police make a report insurance blah blah. The police may prosecute the guy but as for reimbursement you get squat. YOU MUST GO WITH THE COURSE SET CHANGES MAKES YOU NOW THE PROBLEM NOT SOLUTION.
Sucks but welcome to insurance and police life...

well to know for sure .. call ur insurance company .. get to sales+service .. explain the scenario to them .. they will give u some idea of what they think / who is at fault .. and if they ask u for ur policy number to file a claim .. hang up
