My First Ticket, 130 On The 400
So I got nailed with 131 on the 400 today....
Never had a ticket before, dunno what I'm supposed to do..
Set fine of: 186
Total Payable: 226
The cop came up, told me I was speeding and I was getting a ticket, took my liscence then want back to his car, wrote up the ticket, gave it to me and told me to slow down and be safe....
He didn't say anything about points or anything, just gave me the ticket and left.
Do I still get those points and if so what should I do?
If it's only the money I'll just pay it.... But I don't want those points... My insurance will be done..

it's actually 4 points (30-49km/h over limit = 4 points)
It's not the points that will effect your ticket, it's the ticket itself. Basically, once you accumulate about 8 points, you might have to go see someone and explain to them why you are speeding etc. At 15 or 16 points, your license gets taken away for 30 days or more. Also, most if not all insurance companies will let the first ticket slide so you don't gotta worry about your rates going up. However, doing the first appearence might be the best for you (might save you time if you don't have to go to court). Basically what first appearence means is, you go meet with the prosecutor (cop's lawyer) and you can try plea barganing. All you really have to say to him is, "would you like to negotiate a plea bargain?" If he says yes, then he will tell you the lowest charge he can set for you and whether you agree to the fine he has set or not. If you agree, I'm not sure if you will have to go to court before the judge to finalize the charge or not. I've never done a first appearence, I've always taken it straight to court and done plea bargain there, and I had to plea guilty before the judge. I also doubt he'll let you off with 0 points, but if you're lucky he might. But I'm pretty certain he will drop the total payable to about $70. I mean really, it won't hurt you to go and try a plea bargain, you can only win. If not, take it to court and plea not guilty (will need a lawyer unless you are familiar with the court system and can represent yourself). However you need to REMEMBER to NOT PLEA GUILTY if he doesn't want to negotiate a plea bargain with you or if you are not satisfied with the amount dropped and would like to take it to court. GL.

Yes, I do. I actually lost my license back in 2001 because of some issues I won't go into. To make a long story short, I wasn't convicted of anything and my insurance actually went down.

Never just pay any ticket, always plead it down thru negotiation or go to court and plead not guilty. It's well worth the time it will take you for the insurance saving which you will have in the end. If you need a legal rep to go with you for the not guilty plea it will cost a bit more, but some places don't charge if they can't get you off.

i went to court, put in for a date....
was over a month ago...
4/4/08 i posted this, went in couple days after to put in for my date., still havent seen anything in the mail at all about my date, is it possible it got lost?
i wanna kinda call them, cause if i got a date and dont know then dont show up ill get ****ed right?> but again if i call and say that and it wasnt processed or something, im fine???

man, seriously, i just did it recently, the fact is U CANT get out of the ticket, the rules have changed, go to court, they'll drop it to 15k over the limit, no points, plea GUILTY, roughly around a $90-95 ticket, and be on your way, also when i fought my ticket, i had to wait around 6-7 months for a court date, barrie is pretty backlogged, u just cant bargian with them they wont budge, i wouldnt care what to pay just as long as you dont get hit with points, thats what the insurance company's pretty much look at

always fight any ticket you get, cops are bastards, and you should never just give in, your ticket isnt the worst ticket ever, so definantly fight it. Also you should get your court date in a couple of months, once you do that, go down to the courthouse and try getting that date changed. Every citation that cop has given out will be fought on that date they'll give you, so he'll for sure be there, so try changing the date, that will definantly heighten the chances of him not showing up.
