So , here's the deal.

I'm driving home from work a few days ago along a side rd near bradford. My speed is around 90-95 km/h when I come up to a school bus. I follow the school bus for a good 2km, then make a safe lane change to pass the bus.
About 1 min after passing the bus, I get pulled by some pissed off cop. He claims to have waved me down for speeding, but i kept on driving. He threatens to take my licence away for 5 years for not stopping for an officer.
Anyway I calm him down and he gives me a ticket for doing 108km in a 80 zone. So I want to fight this because I think he is full of , he stops me about 5 kms down the road from where he claims i should have seen him waving me down. Does anyone have any suggestions on what to do to fight the speeding ticket,and should I mention about the officer threatening me with taking my licence. Oh and once he found out i worked for Honda, he gave me a lecture about how all Honda workers drive.

deffinately fight the ticket , get a good lawer (not ex-copper they suck) to fight the ticket and then file a complaint about the officer as well.

So looking over the post....is this the story ?

MAXIMUM 80km/hr zone, you are travelling 90-95km/hr (which is speeding) you come up upon a bus (bus is driving speed limit or slower) you "just have to pass" that bus and accelerate faster, and get caught at 108km in the 80km/hr zone.

If the police was in front (stationary) OR coming from behind (moving parallel mode) 99% of radar would be able to get both the speed of the bus and your vehicle.

1) There seems to be no doubt you were speeding, (by your own admission).
2) The officer then warned you of failing to stop (which was nice, so does not matter, consider this a blessing).
Was the officer in uniform? Did the officer have on a traffic vest if doing the "wave over" stop? Was it a full marked cruiser? How long did it take you to notice the flashing lights once activate and pull over? All these would be determining factors why the officer gave you a warning
3) Driving from the Honda plant....well this doesn't take brain surgery here..... not just from Honda, but every plant...as soon as shift is done, it's like a "race track" away from the plant (whether it be to leave OR to get home to see the wife :) )

Distance does not matter to stop a vehicle, sometime the police will be checking the licence plate and registered owner though dispatch OR waiting for a safe place to stop OR waiting for the moron driver to see the flashing lights and realize that they should pull over

Highway Traffic Act, Section 216 deals with "power of police to stop a vehicle". If a readily identifiable police officer signals a vehicle to stop, the driver "shall immediately come to a safe stop". If found guilty, can face a fine from $500 TO $5000, imprisonment or BOTH....AND can have the licence suspended for 3 years.

You also seem somewhat knowledgeable and would be able to walk into court and at least get the speed reduced somewhat by speaking to the prosecutor before hand.........that will save you $500 plus from hiring a paralegal or lawyer

the officer was in an unmarked cruiser wearing just a black vest over top of his uniform. He said he clocked me before i passed the bus. Just after i passed the bus i came to a stop sign and turned down another road. Then i noticed him behind me, way behind me. I thought he might have been responding to another call, so i pulled over. thats when he pulled in behind me. Your right I was speeding, but not doing that speed he claimed.

Unmarked car, an officer in uniform with black vest....that is typical uniform, most have officers have the option of wearing the internal or external vest. If no crests on the shoulder that would worry me. Seems a little more strange now...plead not guilty, ask for disclosure and look at the evidence or even post it for us...good luck
