Racing Ticket
 

Ok people Need some help here have had alot all ready for some people and even the officer who pulled us over. ok Heres the story me and a buddy crusin around when we get swarmed by the chopper and 2 cops we were like WTF then we were told we were racing and the chopper got ous on tape. so then we get the ticket Race Motor Vechicle. The cop said not to lose any sleep its nothin big just go to court.



Anyone got and suggestions on what to do. :thumbsup

simple, you likely got a summons to appear. go, plead not guilty, and make a motion that you wish to proceed with a trial. At that point, they'll issue you a court date. Upon receipt of the court date, take a few days, then submit a request for disclosure to the crown. Ask for all informations and evidence to be presented pertaining to the case.

Also ask for the notes from any officer who was involved. all of these people will be required to attend court.

What - are you a lawyer now? How the heck can we beat a ticket when the chopper catches us ? I heard that thing has video fer chrissake. What legal background do you have ?

Whats your brilliant defence for the chopper ? I got a ticket and its up in October...id like in on your secret to 'winning' if you wanna share it.

Sometimes that chopper is way high and you cant even hear it...then all of a sudden - WHAM - the meets get busted up and there it is. Same thing in York too.....

tell the JP that you have an explanation for driving fast.

you will nvr beat the tape from a police chopper, the cops will gang up on you and lie.

tell the court that you had to go to the bathroom cause you had whicked diarea (the trots)

if the cop or prosecutor says why didn't you say this at the time, tell them you were too embarassed to say anything and you could'nt think straight cause your bowels were twisting if you get my drift.

that sounds so far fetched the JP will give you the benefit of the doubt and let you go with a scoulding.

It worked for me when I got a 60 over on the 401.

I think that the whole court laughed so hard that the JP didn't have the heart to punish me any further. she let me walk...

Show me the wager or Bet?
(Note Flashing the 4 ways can be seen as agreeing u won and braging rights count as a wager)

Now here's the thing, were you actually racing ?? Or were you just side by side speeding ?

Just like you can't really PROVE that you were just cruising - they can't prove that you were racing, So what they have video ? What do they have video of ? two cars side by side - What does that prove ??

Unless you stopped in the middle of the street and lined it up.

I was driving around one night and met up with a buddy and I pulled over next to him to talk about where we were going to go. Next thing I know the chopper's spotlight lights us up and 2 cruisers dart out from behind a factory, they wanted to give us tickets for racing, But my buddy turned to the cops and was like - What exactly do you have to show that we were going to race - we were stopped next to each other - No judge will ever give out a conviction based on that. So they just told us to get the out of there.

Buy the highway traffic act at Chapters, I bought one and it includes case law! Racing is broken down in past court decisions. Trust me and stick to the washroom story.

You think you have the fortitude to question a cop on the stand? And look smart??

In my last time in traffic court I thought I was prepared but when I got my chance I choked. I have seen some of you drive, I don't think you'll do any better than me.!

some times the tapes are to far away or blurry to even tell what kinda car it is check it out to see if its even your car

Sounds like Speedy is a little bitter...Did he pulled over a couple times this past weekend?

fight the ticket! If scoty knows a way to get off it all the better if not try getting a lawer to fight it. My friends and I use Henry at Redline legal services , they ussually get most tickets dismissed

ok heres the thinG i went to court for it they said they have a video so they do i went and they said one of th jps were not there so its goin to be delayed for my court date then the other jp said oh yea the crown is askin for 6 MONTHS yea jail term there not in around no more they said this new program E.R.A.S.E there crackin down hard on street racing. but we were just drivin down body besdie eachother we didnt stop nor race so how is that a street race thought a street race was when u stoped took off then finshed somewhere not drive then get swarmed but cops ITS BS .

1) Ask for disclosure of the video

2) Statement "JP saying they're not f....n around" Call BS on that statement as a JP stating that in those words...not likely as your case would have to be adjourned on a recorded document.

3) "Just driving beside one another" ............who on here would believe that...you were both driving side by side, at the MAXIMUM posted speed limit and then you were pulled over for racing, b/c the helicopter and police on the ground all thought you were racing or they were bored. Helicopter probably had been tracking you both for a few minutes until a couple of cruisers could get in position and intecept, by then you might have slowed down.

Hmmm, why is our insurance rates always going up? Young inexperienced drivers doing things on the road, that should be kept only on a track.

If we wern't to be in canada , poorly worded legislature maybe would get amended and you wouldn't get ed over by it .

but because we are in canada , poorly worded legislature , only means that the person who wrote it was an idiot, but to respect the law we must obey it and assume a lot more .

as you remember i was in a similar situation , the cop had no speed for me , and of course no bet or whager or whateverthe .

on top of that i was let off on a technicality , only to see that the cop could pull out stupid technicalities off his own and screw me over even worse .


I used the place you sugested , and the "lawyer" simply waited for a prosecuror that was willing to give me SOME FORM of a break . He found one that would give me 40 over and 4 demerit points , and then his job became , convincing me to take the deal .


Which brings me to what people were asking about scottyp . He might as well be a lawyer . You know you don't need to be a lawyer to be a "trafick lawyer" . Most of these s are paralegals or ex cops . You could even be a janitor , as long as you got clients you can "represent" people in court , that meaning , going in court to ask the judge for a break , which comes by default anywais , only difference is that you get to charge 150 $ for it ( no pun intended to scottyp ... sup dude :D )

good thing your not in Los Angeles... they would crush your car!

I do believe they need not prove a bet OR wager, only that a race took place, I know this because I did a lot of research :la: on my BS 7 day punt from the forum. :stroke:
