Should i fight this speeding ticket

Okay, i was driving on this 50 zone, and was appearently going 90. for like 3 secs, just to test out my new transmission. (if that even matters), anyway. i get pulled over by this unmarked vechicle. he told me i was going 40 over, but gave me a 10 over instead. zero points, just a $40 fine. on the ticket he didnt put a reduced markings anywhere. just stated i went 10 over limit. Is it worth fighting this ticket? will my insurance go up that much? i already have another ticket a few months back for going 15 over, on the 401.

lowbalt 07-06-2007 09:43 AM

Up to you bro. I woold fight every ticket, but it looks like the cop already gave you enough of a break, and I dont think 10 over would affect insurance. Because its no points.

xudeck 07-06-2007 03:27 PM

Yeah, no point fighting this one. You just got lucky with the cop !!! And its 40$ so yeah...no points..no biggie !!

T_squared 07-07-2007 11:45 AM

as long as it wont **** my insurance up. i dont mind. but i already have another 15 over ticket a while back. no points either.

wolfpacinc 07-07-2007 04:42 PM

fight every ticket man

voltar 07-08-2007 08:21 PM

Definitly fight it no doubt about it. Keep your record as clean as possible or the insurance mafia will get their tentacles on you eventually.

StealthZ 07-09-2007 12:43 PM

wait a minute...you decided to go 90 in a 50...the cop busted you being stupid, then only gave you a ticket for going 10 over even though you deserved 40 over and a big fine, yet you still wanna fight this $40 fine?

I still say insurance here is like organized crime

brownkaos112 07-25-2007 03:18 PM

of course you should fight it... I see that a lot of ppl say on these forums to just pay it because the cop gave you a break

Umm regardless of whether he reduced it or not, your insurance will got straight up even if no points are involved... Points DONT dictate ur insurance rates, number of tickets convicted do.

So definitely fight every ticket.

I agree, besides if the cop really wanted to give you a break he wouldnt have given you a ticket at all. It's just their hope that you think they are doing you a favour so you pay it. Remember thay are not trying to do you a favour, they are trying to F$%* you. The faster you learn that the better!

JRPGDAVIES 08-10-2007 08:08 PM

why fight a ticket when you have already won man, you got off real lucky

semendemon 08-11-2007 02:50 PM

^ It's retards like this guy you shouldn't listen to if you don't want to have to cancel your insurance, because it will be too much for you to afford (with all the convicted tickets). When you get tickets with points, you can take them to court with or without a lawyer (preferably with) and get them reduced to a lighter violation that has 0 points. When you are filing them, make sure you always check the option that says you are going to challenge the officer's evidence, because that is the only way you can hope to get the ticket dropped completely. Basically, if the officer has no evidence at all (which are the notes that he takes when he goes into his car) or you go to trial and challenge his evidence and WIN, then you can drop the charge completely and that is what everyone should try to do! My lawyer and I have done that for 6 of my last 7 driving violation tickets. Not only did we drop the points, we dropped the whole ticket. However, my insurance did still go up because of my one conviction that had 0 points. Points are just a measure of how long you have to keep your license. A G2 license can have 9 points before it is suspended and a G license can have 15. Therefore, ALWAYS FIGHT THE TICKET, ALWAYS CHALLENGE THE EVIDENCE, AND ALWAYS TRY TO GET YOURSELF A REPUTABLE, EXPERIENCED LAWYER! :)

valentin 08-11-2007 09:18 PM

^ well said. fight it.

acuraTL99 08-12-2007 02:56 PM

fight with an explanation

You can plead guilty with an explanation.
There is no trail and the police officer will not be there. when you go the court house tell the person at front desk that you want to plead guilty but with an explantion. You wait for your public defendent(free of charge). She will ask you straight up if you did speed 10km over in the 50km. You say Yes I did ma'am and tell her that your foot sliped and the new transmission is a bit tricky (dont get too cute with the excuses). Shes will tell you that the fine might be reduce and no points. Then you go and sit and wait for name to call before a judge. Your lawyer will state your case and that you pleaded guilty with an explanation. The judge will ask you if its correct. You say Yes Sir. Most likely the judge will reduce the fine and no demerit points. You say thank you and leave to pay the reduce fine. Everything should be fine unless you act like a dink.:la:

turbovr6jetta 08-14-2007 02:29 PM

if you fight it chnaces are cop might show up and explain to the judge how he was nice and let you off for doing 40 over.

Also though if you fight it cop mite not show and you win.

yu have a 50/50 chnace.

ur call buddy either way good luck with what you do

StealthZ 08-15-2007 12:42 PM

you know what...fight it. i pray the cop shows and your dumb ass gets railed by the judge for being a stupid punk. good day.

djtelx 08-15-2007 01:03 PM

definitely fight your ticket, not worth the hassle of going through insurance broker after broker

wutanggrenade 09-05-2007 08:21 AM

I was let go with a 10 over, and I asked the police officer if it would effect my insurance. He said,"it shouldn't if you pay it ASAP". So the next day 9AM (9:02 exactly on the receipt) I payed it. It still affects insurance, a ticket is a ticket. That was 3 years ago, a 50 ticket has now cost me over 3000 dollars since my insurance went up a 100 bucks a month. So I say fight it, it won't hurt any.

fat_stan 09-07-2007 06:07 PM

you should fight every ticket no matter how small the fine... Cop might not even show (won that way twice)

ForceFedSi 09-07-2007 10:55 PM

they can't raise the fine nor can they attach any demerit points to the ticket. he has nothing to lose by fighting the ticket. i dont see how he can get railed... by the way ur an idiot.

jdmdave 09-12-2007 05:05 PM

Not Guilty

Great Traffic lawyers to deal with, they are really good at what they do, they have gotten me off 4 tickets thus far. and have also helped several of my friends.

jrsek 09-21-2007 02:17 PM

i'd fight the ticket. you might even get off that ticket because the cop might not want to show up for a small ticket. i went to court for a 5 over, the cop was a big but he never showed up.

gts-ter 09-26-2007 12:54 AM

so what do u say if the cop does show up....(just happened to me) caught going 18 over in a 50...with a radar. what do u do if they do show up?

youre wasting the courts time...and if you go there like an idiot with nothing to prove but hoping the cop doesnt show, you may be forced to pay court fees.
****in tool.
forcefedsi, lmao.

regardless of what this douchebag says you will not be forced to pay court fees and you may get off on the ticket... good luck bud.

forcefed jbody FTW?!?! :loser:

drac 10-03-2007 01:25 PM

Go to court!

1995 5L 10-09-2007 03:10 PM

Fight the ticket, whether it's 10km/h over or 50km/h, every ticket you are convicted upon will increase your insurance premiums. A 10km/h over conviction will cost you no demerit points, and only a $45 fine, however the ticket will be noted as a minor conviction on your insurance record. I recieved a ticket for this and it increased my payments by $10/month which isn't so bad, but it is still $120/year.

gts-ter 10-09-2007 03:24 PM

i've decide to fight my 10km over ticket...and if i see the officer come in or is in the court room i'll either say i was just following traffic and i was targeted since i have a sporty looking car (big spoiler and kit) and/or i goto school so i wanted to just reduce the ticket price. what do u guys think

1995 5L 10-09-2007 03:30 PM

When you go to book your court date, request to meet with the prosecutor first. In doing so, you may be able to bargain with him/her and have them change the charge or drop the fine. Either way it's worth giving it a shot, if your not satisfied with the results, then proceed with the court date.

gts-ter 10-09-2007 03:36 PM

but what could i say?........"can u drop it please i cant afford to have this on my record considering how insurence is rising (after elections)..lol"

civicSI95 10-25-2007 10:05 PM

Fight it. Take it from someone that is in Policing ... honestly, he wont show up and it will get waived
