speeding ticket at bathurst/ hwy 7
hey guys, i got a speeding ticket (114km/h in an 80 km/h zone) a while ago, and the court date is coming up next week, and i had a question to you guys. i noticed that where the cops were parked to pull people over on hwy 7, theres a "No Parking Anytime" sign right above where they parked. does that matter, or can cops park wherever they please? cause i mean, it says dont park there, so didnt they break they law by doing that first? thanks in advance to anyone who replys with useful info.

even if im sure they are exempt from the sign cause thats who the sign is probably meant for to unblock for emergency vehicles... |

haha thats what i thought, thanks alot for the replys guys. oh yeah one more question, do i ask for his training and calibration records of the radar detector in court, or before i goto the court date. thanks again.

For a speeding ticket, I would never request Disclosure (pre-trial Crown evidence). I would have asked the officer the type of device used at the stop. That's all I need to know.

If a vehicle is left unattended then it is parked. But with someone still inside with the engine running it's just stopped. Hope you asked for disclosure. If he didn't write down any evidence of your offence then you're lucky

just wanted to update you guys, i had my court date today in newmarket and won. this was due to the fact that it was a multi officer speed trap, and only one officer showed up. the hearsay rule prevents him from speaking on behalf of all the other officers so the ticket was dropped. thanks to everyone who replied to the thread.

Curious... did you request dismissal based on the officer's absence? Or did someone else (crown, JP) just drop it before the trial even started? Oh, and did you have an actual defense planned? Or did you just show up and hope for the best? Bookm |
yep, i requested for dismissal before the trial formally began. beforehand i had negotiated a plea bargain of 15 over with no points if the cop actually showed. but from this website http://www.magma.ca/~fyst/ i found out that since it was a multi officer speed trap, ALL of them had to show up or else the case would have to be thrown out due to the hearsay rule. so once i was called up, the prosecutor started saying that i had accepted a plea bargain but i stopped her and told her that i changed my mind, and that due to the fact that all of the officers required to be here arent here, my case should be dismissed, and thats what happend. i did have a defense lined up from info gathered from the above site, but this was what i was hoping for and it came true. haha, just today i beat out another two tickets, one for a small speeding ticket 69 in a 50, and one for unnecessary noise. the OPP cop didnt like my custom side exit exhaust that me and my dad made, but i guess he didnt care enough to actually SHOW UP in court. im done ****ing around tho, at 20 ive had to fight too many tickets, thankfully i won all of them, but its time to start obeying the law. even tho it does feel good to beat the system.
