Speeding Ticket Court Date Questions
 

To sum it up,
- 32 over in a 60
- 130 fine
- Court date was set over 1 year and 1 1/2 months from offence
- caught in a speed trap

Main concern is to have no points deducted the fine is not a problem
1. Would the Judge be open to reducing 3 points to zero if I pay the fines?
2. Can I somehow get out of the ticket completely because it has been 1 1/2 year since the offence occured?
3. I have a clean record other than this one ticket other than the cop not showing what are my options to fight it?

P.S The ticket was not reduced in anyway way at all by the officer.

1. if you pay the fines? if you say that you will pay the fines, that means you're already accepting the charge and saying that you did speed; if you admit your fault then what reason would they have to let you go? rare events might happen to the lucky ones but what do you think your chances are..

2. no- how about getting rid of all murder cases over 1.5 years ago? even if it was 50 years, still it would not have been okay because the case hasn't been settled.

3. you were caught in a trap- the trap that they set up because they knew someone might do something at that location during that time of the day..

P.S whether the ticket was reduced or not, it will not help you win/lose the case

you should be happy that the court date is 1.5 years later because your record will still be clear during this period ;)

my advice to most people are the same... if you really want to get rid of it, get a trustworthy ticket fighter, because if you don't win the case, your insurance will cost more in the long term than the $300 for your ticket fighter (especially if you're young). if you want a good recommendation then let me know- shes gotten rid of lots before for some of my friends and I.

btw, 'no points deducted and fine only' is also an offence (minor offence), it will be on your record and will affect your insurance; usually it will still be considered as one ticket.

You want to have your Lawyer ask for a Stay of precedings as your right to be tried within a reasonable time pursuant to s. 11(b) of the Canadian Charter of Rights and Freedoms, has been violated

after a year and a half, you should get the Stay...
