Unnecessary Noise Ticket.
 

I recieved a speeding ticket a while ago back. I was doing 140km/h in a 60k/m zone, ya, stupid. Anyways, my ticket was knocked down to 20km/h over but he stuck with me 2 other tickets to make up for the fines I would've paid. He wrote me a changing lanes without signaling ticket (guilty) but then wrote me another $110 fine for Unnecessary Noise. The reason; I was caught by radar, so when I was flagged in, the officer stepped into the road to pull me in and I was going so fast that I had to lock up my brakes and ended up skidding.. does this fall under an Unnecessary Noise violation, cause I'm damn sure it was necessary to brake in order to prevent hitting the officer. - When someone steps out in the road, you have every right to mash the brakes.

- The statute relating to signaling:
142. (1) The driver or operator of a vehicle upon a highway before turning to the left or right at any intersection or into a private road or driveway or from one lane for traffic to another lane for traffic or to leave the roadway shall first see that the movement can be made in safety, and if the operation of any other vehicle may be affected by the movement shall give a signal plainly visible to the driver or operator of the other vehicle of the intention to make the movement. R.S.O. 1990, c. H.8, s. 142 (1).

It's VERY important to the prosecution that the cop states that another vehicle was affected. I beat this ticket once due to the highlighted portion.

Fight both charges:
- Follow instructions on back of ticket.
- Ask the court clerk how to request Disclosure
- When you get your court date in the mail, attend and motion for a continuance AND separate trials (but be prepared to defend both just in case you lose this motion.

Do your research on how the trial process works. You have great defences. Don't screw it up ;)
