Agressive driving maneouver - who is liable?

Tonight, while on a sharply turned on ramp, I notticed a Mini trailing behind me. It seemed the driver was attempting to dangerously pass my lumbering Volvo in the turn. However, I watched him carefully and adjusted my vehicle according to his swerving.

As I merged into the highway, he immediately followed. While I was driving at a non-reckless speed, I attempted to move over both lanes. He, however, wanted to jump over two lanes as well. He came up from behind at a much greater speed while we were both executing the same maneouveurs.

In the event of an accident, in an identical situation, who would be at fault?

Well first off all your not suposed to jump two lanes and second off all, the guy behind you would be at fault because they are suposed to be 3 car lenghts behind you, therefore giving them enough time to slow down if you were to get into an accident.

I don't understand fully, how they manage to always beat me to the lane. I'm in front of them, and a reasonable person would expect to be given enough respect to get their *** over to a lane. I realize they cut across sharply, and that's not what merging is about.

I've talked to my insurance company, and they've told me, that traffic changing directions is usually the one at fault. This however seems more complex because of a merge.

Some of it comes down to foreign drivers, and cars with performance suspensions.

I don't have the answer to this, so please enlighten me.
