Police will be looking for more than drunks when hunting impaired drivers.

A new law kicks in today that allows police to demand blood, urine or saliva samples of drivers suspected of being under the influence of drugs.

Jonathan Lapid, a criminal defence lawyer specializing in impaired driving cases, questions how police will use these new powers. "In order to get to the point of a (drug test), you need reasonable grounds of suspicion."



And defence lawyers are waiting for the chance to challenge the new law in court.

"At some point, this is going to have to undergo objective scrutiny under the Charter of Rights and Freedoms," Lapid said.

The federal government is confident the law will stand up in court, but past cases may not be on their side.

In a January 2003 case in Pembroke, a judge acquitted a man of driving while impaired by marijuana use because the judge wasn't able to determine whether it was the drugs or his pre-existing multiple sclerosis that caused the erratic driving.

It's not just defence lawyers who have concerns over the new law.

The Canadian Safety Council has spent the past few years offering up proposed changes to the law, recommending the federal government delay its approval.

Seeing a group known for its mascot, Elmer the Safety Elephant, hesitant about a law aimed to curb impaired driving may surprise some, but the organization's reasoning is straightforward.

The lack of a "defensible criminal impairment level" for marijuana and the fact prescription drugs are included without setting limits for the "22,000 drugs available in Canada" concerns the group.


New laws for high drivers take effect
Canadians who drive while high won’t be able to refuse roadside drug tests under new laws that kick in today.

Police can now require drivers to submit to roadside tests.

Officers also have the power to take suspected drug-impaired drivers to a police station or hospital to give a blood, urine or saliva sample.

Under the old law, police were obliged to tell drivers suspected of being high that roadside tests weren’t mandatory.

But as of today, refusing the test will be considered a criminal offence.



Drivers convicted of drug-impaired driving now face a minimum $1,000 fine for a first offence and a month in jail for a second conviction.

ya know if thats for high people make it shorter thats a lot to readin gonna catch alot of idoits thought so its good its aight will live. some of us so wats about people on medication that makes them drosy does that count as impaired.

lol I dont get it... Most the drugs stay in your blood for about 2-3 months... How will they determine that you were using it while driving??

well I assume they would only give you the test if you were showing signs of driving erractic just like people who are drunk

not everyone stopped that had a drink has to do sobriety tests

Isn't this just another infringement of our constitution they can make you take a urine test this is BS. Every week I see a new law being passed that takes away our current freedoms and liberties.

The article says Canadians who drive while high will not be able to refuse a test. So if we're not high and they ask us to do a test we can then refuse it? What about prescription drugs? This law seems to leave to many grey areas and gives officer even more power to do as they feel.

On another not I know a dumb blonde who's 17 years old on her G2 and well she drove down the street car tracks on Spadina when she was high. I hope they catch her.

i left communism, to come to a country that is becoming more and more like it.
With all these laws coming out,it feels like the charter of rights it getting thrown out the window.

wow I'm impressed by everyone's attitude here !!!

Normally i'd bitch that all canadians look the other way . Normally I'm the one bitching on theese sites about such stuff , and everyone is bashing me ...

I see that you guys are unanimous on this ... i'm wondering if anything could come out of it all .

The way i see the difference in between Romanians and Canadians , which are nations that are whipped by their government , and Hungarians, Dutch and French ( for example ) which are nations that don't bend over for each new law ...

The people that treasure their freedom, ARE KNOWN TO PROTEST , are known to go out on the streets , are known to overthrow governments . In hungary they had a silent revolution some 2 - 3 years ago , can't remember what they didn't like . Bottom line is , the goverments in western europe , do fear their population, as oposed to people in countries like canada , where the population fears the government .



As for high driving ! THE FIRST I got on TSR , that made me put on this anoying face , was when i made a post about me driving high , and every single caker jumped on my *** for it .

Well I have not changed my opinions ( allthough beeing in europe , i don't need to drive or smoke weed now ) . And I have slips to prove it . After two big fatties at cayooga , I smoked a 12 second mustang with sleeks on the 60" time . I got a 14.1 quartermile time on a 4 door civic with H22 and 14" semi bald all season tires . And all my reaction times ranged in between 0.5 - 0.9 seconds ! ! !

Not to mention the fact that a guy like me ... having to drive daily through canadian cities ... will most likely bring a bat and hit cars with it since in canada you encounter an idiot while driving every 3.5 minutes ( this is an average i calculated my first 2 hour drive in canada after spending 1 year in romania ) .

Personally ... when driving in canada ... I NEED A JOINT , to be able to behave myself ! Otherwise you snap ... To many people from goat ****ing country , and too many irish+native+scottish descendants calling themselves canadians , cutting you off , wanting you to go 90 in their country eh ...
Anyways don't bash me for the nasty i said about them . Cuz after all I live in europe now , and as this post reveals it ... YOU GUYS ARE the ones suffering now I really do feel for you ... cuz i've lived through it myself

Guys just be happy you dont live in the US. I left Canada and I wish I was back, the rules about everything are much more strict here
