there goes my paint job
april 2005 -- so i drive a 97 integra with a new paint job and some guy in his mid 30's reversed right into me, ruining my paint job and bending in my fender. must suck huh? this happened on bathurst st. so i stopped as i saw a truck was trying to reverse into a parking spot and he was infront of me unaware of what was happening. all of a sudden i see his reverse lights on -.-'' i swear i honked like a mad man hoping he'd stop. i got everyone else's attention but his. the fact that he reversed into me was already bad enough, he even tried to run. but i kept on honking so he finally pulled over. i tell him to give me his insurance papers to copy it down and he can go. but the guy says he doesn't have it. i had to call a cop over sayin if he doesn't show the insurance paper, he'd get a ticket for not having it while he's driving. first he started crying n sayin he has no money and he is living off welfare. i was only asking for $300, half of the price of the paint job. i think it's reasonable because after the accident, the paint started cracking. so after his emotional break down my friend finally made him sign a paper saying he'll pay me back within a year. he says that i caused him to stress and it's making him have medical conditions. isn't driving more of a stress issue?
anyway, it's been a good 7 months and i asked my girlfriend to call him asking to see if he has anything at all so i can pay for tuition. but the man says he doesn't have any money at all and he ain't gunna pay. he says "what you gunna do? bring me to court?" so what should i do? would claiming off his insurance make mine higher? i was thinking to consult my lawyer asking for legal advice. but i still wanna check out what you guys would say.

bring his *** to court, if you want the $300. trust me, people like this arnt gonna pay. however, i personally would do this--> if you can afford it and want to avoid all this hassle (lawyer, fees, insurance hassle) forget about it and treat it as, "a $300 lesson". btw, if you do decide to go to court, watch out for him talking about you making his stressed and ill and whatnot. my two cents

Ok, so you got your friend to get him to sign a paper, and then you get your girlfriend to call him on the phone. What next... are you going to ask us to go to court for you?
Maybe if you didn't seem like such a push-over, and you actually delt with this guy yourself, maybe he'd pay up. Just a thought...

Next time dont let them go without getting the insurance first . Look at the BS you have to deal with now. He is probably at home laughing at you. Your insurance shouldn't go up cuz he hit you. Take him to court teach his *** a lesson. Not sure if you need a lawer tho. If you go to small claims I dont think one is neccessary.

ya, that would be brilliant cause youd either end up in jail or paying for damages on his vehicle.
Pursue it civilly if its a must. Send him a registered letter with a copy of the signed document and ask him when he can pay. If he cant that you will be forced to pursue civil litigation. File.
Expect a long process that pisses you off and will more than likely not be worth the $300 youre after.

The guys on welfare = he has no insurance. Your gonna have to just take the loss or goto court forever....and even when you do win....it doesn't seem like he's gonna pay right up! If he doesn't have any money....your not getting any...call the cops.

quit being a , he ran into you so you're entitled to the money to fix the paint job stop getting other people to do your dirty work
oh yea your girlfriend calling him thats really going to intimidate him
you should have got his address in the first place and showed up at his house and if he didn't have the money take his tv and other assets of his in order to make your money back
if i ever get in a crash i hope its with someone like you so i won't even have to pay just shead a few tears
