No he didn't. He overbalanced while trying to avoid a car being driven at
him and - most regrettably - hit it with the stick he was carrying.

Ah, yes, of course...
Just like the tosser in the car didn't *deliberately* swerve at him -
heavens, no, why on earth would he do that? And, of course, he was coming
back to apologise when the nasty man threw stones at his car all
unprovoked.

I suppose I could have just jumped off very narrow shoulder of the road and

I walk down this road almost every day, and sometimes at night. He has not
dared to do it again. I don't know where you live, but around here, car
drivers are not allowed to threaten pedestrians like that.

Yes, in law. He threatened me verbally, and then came back and threatened
me physically by swerving at me at high speed. That is assault, and I am
entitled to react. He got a handful of gravel thrown at his car and he
left. He used a 2,000 lb automobile to threaten me because I dared to walk
on the side of the road. I used a few ounces of gravel to ward him off.
Which do you figure used excessive force?

I don't know where you got the impression that I was standing in the middle
of the road when I threw it.

Yes, dear. And you either needed to get out of his way or you didn't.
Since you apparently didn't dive for the ditch, but didn't get flattened,
then we can assume that it wasn't necessary.
<thinks>
You aren't actually under the impression waving your stick changed the
trajectory of his car, are you?

Nor here. Nor are peds allowed to belt cars with big sticks.
Perhaps he hasn't been down that road at the same time as you since?
Perhaps he wasn't a local?

I don't know where you got the impression that a vehicle stays in the
middle of the road when the driver loses control whilst swerving.

Did you get lost in the sequence of events? I did not throw stones the
stones at him when he came back. On his first pass he came barrelling by
at a high rate of speed and so close that I was able to make contact with a
short stick I was carrying. He had lots of room to move over. I did not.
There was a ditch and no real shoulder. I was walking two large dogs...
hard to get moved over. Perhaps I should have mentioned that he blasted his
car horn at me. Apparently he thought I had no business walking on the
road. I was dressed in light clothes carrying a flashlight which was
pointed at the ground and being moved about so that it would not be
confused for an oncoming vehicle. I was walking on the proper side of the
road, and in this country cars drive on the right, so pedestrians walk on
the left.
He came back and yelled and screamed at me for being on the road, and for
being on the wrong side of the road. I was a pedestrian on the edge of the
road, since there was no shoulder, and he apparently was too stupid to know
which side of the road pedestrians are supposed to use. He threatened me,
saying that if he say me on the road again he would run me over. Then he
took off, went a few hundred yards to the a driveway where he turned
around, then came at a high rate of speed and veered toward me. I did step
back, getting out of his way and whipping the handful of stones at his car.
Call a cop and see who would go to jail.

Amazing how you can sit behind the desk and make these judgments. I'd like
to see you in the same situation and see exactly how you'd react. Perhaps
you could get his license number and have the driver tracked down so you
could mail him a note voicing your displeasure at how close he came to you.
Yeah, send a note on nice stationery.

Not at all.
Merely pointing out that Ian's suggested excuse can be worked both ways.

Do forgive me...
I took "I stepped back and picked up a handful of 3/4inch gravel off a

I'm merely trying to point out that there were two ing idiots involved

shaking your head at the total ing stupidity of your fellow mankind,

Not when he came back the first time.... only on the third encounter with

Hopefully the next time he saw a someone walking along the road and though
it was his duty to chase the pedestrian off into the ditch he will remember
what happened the last time he tried it. Maybe he was stupid enough to go
to the police and tell them what happened and got tuned into the rules of
the road and that "dangerous driving" like that is a criminal offence.

Or maybe he'll just be even more irrational around pedestrians, since he'll
remember the one who twatted his car with a stick then threw stones at him.

I have to point out that if some idiot decided to a) deliberately hit my car
with a stick, and b) throw stones at it after shouting abuse at me (although
I wouldn't a) not leave room or b) swerve at a pedestrian so this should
never actually happen) then I'm afraid to say it'd be out with the
wheelbrace and I'd happily leave said pedestrian hopefully dead or dying in
a ditch.
I enjoy walking in the countryside, I also enjoy driving in the countryside,
I dont see why either activity should be frowned on by people doing the
other. If I'm walking down a dark country lane I leave room for traffic, If
I'm driving down same lane I leave room for pedestrians and even cyclists.
People seem to forget that pedestrians quite often drive, and drivers quite
often walk..

As would many. If you were a fellow like the one I encountered, who thinks
pedestrians have no right to be on and so unaware of the rules of the road
that you didn't know which side of the road people are supposed to walk on,
and thought that when travelling down a country road after dark way in
excess of the posted speed limit, that rather than maybe slowing down or at
the very least moving over a little to allow a safety margin, the
appropriate thing to do is to lean on the horn and get as close as
possible, you would probably be even more disposed to that attitude.

Same here. I have no problem with people walking or riding on the road
when I am driving, or with people driving when I am walking or cycling. It
is a different matter when someone is driving in a manner that endangers my
safety.

If only drivers drove the way they expect others to drive when they walk,
and walkers walked the way they expect people to walk when they are
driving.
