Anything in the HTA relating to rate of acceleration?

Is there anything in the HTA that speaks to rate of acceleration? Imagine this scenario: If Im at a traffic light, and decide to accelerate as fast as I can up to the speed limit, could I be charged with anything under the HTA assuming that:

a) I didnt spin the tires at any time
b) I maintained full control of the vehicle (i.e. I did not put the car sideways)

I did this once and was charged with Uneccessary Noise. I was convicted in court despite my claim that I had a factory exhaust system and I didn't spin my tires.

I deduced from this that there is no statue relating specifically to acceleration, but they'll find somethin' else to hammer you with.

My question is: If you do this, and the guy beside you does too, is this automatically considered "racing" ??

In many states, they slap you with "exhibition of speed" violation. They can always come up with something.............

He can try, but it would NOT hold up in court.

There is nothing in the HTA specifically relating to rate of acceleration.

Common sense (or what should pass as 'common' sense) however, says that tearing out of a stoplight in front of a cop is probably not the brightest move. You're essentially giving them a reason to pull you over and see what they can write you up for.

Is it street racing if the car next to you does it too? It would look enough like street racing for an officer to ticket you for it. While it may not stand up in court, it's a lot of hassle.

how about just revving high at a stop like, or a little peel out? i drive a 5 speed car, and sometimes i peel out, not on purpose(still getting use to driving 5spd).

Hey Bookm, does unnecessary noise count as a moving violation? Cuz that could either be from accelerating hard or just pumping ur music. Basically I'm just wondering if it affects your insurance.

Anyway, I did that once too. A cop started chasing me. I was accelerating fast, but I wasn't actually speeding by a lot so I quickly slammed by brakes back down to the speed limit before he could catch up to me. He rode my bumper so close. He was probably an inch away from my car. He would've rear ended me if I tapped my brakes. He followed me for about 10 mins and I stayed 60 km/h on the dot. Then he finally left.

My friends were with me at the time, and they all accelerate fairly quick off the line too. Fortunately they saw the cops and didn't follow me. Otherwise it would've looked like a race. The fact that we all drove modified Japanese cars doesn't help either.

If my friends didn't see the cops and we all took off together, I probably wouldn't be so lucky. But I would still go to court and try and fight it. I mean the two guys that were doing 140 on a 50 zone in their parents' benzes went to court and the crown couldn't prove it was racing. (How that is not racing, I don't know). But I would take my chances in court and make them prove that going like 70 in a 60 zone is racing. Maybe it would've worked, maybe not, I don't know. I'm just glad I didn't have to find out.
