fight stop sign

I got ticket for failing to stop at stop sign in Toronto. i heard that the police officer must see the stop line, if there is one, from where he was sitting. That is exactly my case, Is it a strong case? If so do i need a picture to show that there is a stop line and a picture to show that he could not see the stop line from where he was sitting?
Any help would be appreciated

Yes you need pictures. Make sure that you ask for the police officers notes before trail. If you are actully guilty of not stopping, Id see if you can plea guilty to a lower offence, ie; no points & 100$ fine or something.

No, the police officer does NOT need to see the stop sign.

Cop needs to explain that there are stop signs in place and that there was a clear and unobstructed view of the vehicle. If you rolled through the sign then s/he will prob state that they did not see the wheels on your veh come to a complete stop. If you can prove that the view was obstructed via photos then do it. Otherwise you're going to have a hard time with it. Generally if you plead guilty w/ explaination before a JP then they'll knock the fine down for not wasting the courts time. If you do go to trial and lose then you're getting hit with the whole thing.

I have the same case coming up on the 20th of this month. Similarly it was night and there is no way the cops could have seen the stop sign much less my car and hardly even my lights. They hit me with the same charge because I "cut them off". I'm taking it to court because its proposterous to charge me with an offence that you have no idea even occurred. Especially since they pulled me over wayyyyy after the intersection and they were the car directly behind me. Take pics, take it to court. You stopped, they couldn't see...bottom line.
