HTA 136 (1)(A) - Stop Sign

Got nailed today. I think I can raise some doubt about if he was able to clearly see me. Whats a good defence for this one? Anyone won this in coourt? Please share ur story. Should I bother with prosectur meeting? Is it likely they will offer lesser charge?

Serious posts only please, none of this "You could hire a traffic lawyer"

He has to be able to see your wheels come to a complete stop or not... overall hard to fight his word vs your word...

Relax and be patient while enjoy your life are the keys. This thing takes time. File the form to contest the charge. Wait till you get court day in the mail. immediately request for disclosure. Wait for disclosure. If you dont get disclosure your chance of winning is good.
after get disclosure, prepare your strategy of defence. Many ways:

1. charter of right, motion to stay
2. lack of disclosure, motion to stay or adjournment
3, find ways to delay the trial to increase chance that cop dont show
4. trial is last resort, usually you loose regardless of your good evidence
5. take plea bargain, less fine, no point
That's what i learned thru reading from internet and many times appeared in court, so read www.ticketcombat.com

Ive seen this one in court before. The judge ended up throwing it out cause the cop said he had to remain there for at least 2 seconds. the judge asked the cop to show him where it said 2 seconds in the H.T.A and the cops tail curled up underneath(he turned red like a tomato) (IN the H.T.A it says complete stop but there's no time factor). So the Spanish guy (Charged) got off not becuase he didn't stop(which he didn't) but what the cop said to him after. I guess that's one way of beating the ticket.
