RE: radar manual for Decatur Electronics, which makes Genesis
Effective 01JAN05 Decatur Electronics has changed the manual for all police that use their products. The manual has been updated to reflect Canadian standards (km). The tuning fork test procedure is also completely gone and does not need to be done, hence if an officer is still using tuning forks after 01JAN05 they are not testing the unit properly.
Testing in a nut shell... unit turns on, make sure it goes through it's self test , then officer presses the test button, then a comparison to patrol speed when moving and that it. Pretty easy, these radar units are all computer components and any error it will shut itself down and not allow the user to use it

As well, since that has come to light (the tuning forks bit) officers will typically continue to "use" them (at least claim to in court) and therefore the unit will not be operating correctly and the evidence presented by the unit will be dismissed leaving you only to have to disprove the officer (the easy part).

This has been an interesting thread... Considering Im going to court on Friday, I thought I post my scenario to see with you guys think..
On Aug 2/07, I was stopped for going 110 in a 80km/hr zone up north on HWY9 between towards Orangeville
I was behind 2 other cars (kinda in a cluster), on hwy 9 east bound.
OPP cop in a black car was driving the opposite direction (west) towards me. I noticed the cop immediately because he flashed his lights as he approached the first car. He U-turned around 100 meters or so behind me. Assuming that I wasn't the one he clocked, I slowed down and pulled over a lane to let him pass me.
It was probably the first car he clocked however, since I was the last car in the "group" and was the one who pulled over, it was just easier to slapp me wiht the ticket.
I've asked for disclosure on the following items:
- Both sides of officers copy of the ticket
- Copy of all officers written notes regarding this charge
- The make of the radar/laser unit
- The model, and serial number of the radar/laser unit, and its owner's manual
- officer's training record specific to the radar/laser unit
- All repair history of the specific unit
- The records of calibration of that particular radar equipment on August 2, 2007, and six months prior.
- Official procedure for radar/laser equipment testing and operator training standards
- Any document the Crown may rely on at trial
I recieved: officers notes, which most it in abbreviated form that I cant understand, copy of the ticket, and the radars test manual, with the explanation that "the Prosecution feels that other requests are not relevant to your ability to make full answer and defense of these charges".
Here is what I received in Disclosure:
Here's the thing, the officers notes are exactly written as:
Travelling W/B Cty.Rd.109 80K/hr
W 3rd Ln W/Gara Tp (WN) obs.
E/B M/Veh app to be speeding
Activate radar unit #161
Clocked - 111km/hr 50m
Locked - 111km/hr
Chgd- 110km/hr
D1 I.D by photo DL
07 Jeep Liberty Sil
Only veh in beam sight
Never lost sight veh
weather - clear, hot
Rds - dry, straight
Radar test - 1545hrs
QMI Ok - 1608 hrs
the fact is, he saying that I was the only vehicle in "beam sight" when I was infact 3rd behind 2 other cars! and I dont understand this line: "W 3rd Ln W/Gara Tp (WN) obs."
Essentially, it could come down to my word against his on this..Incidently, how ironic that he tested the radar exactly 13 mins before he allegedly "clocked me", when he was driving towards our cluster of vehicles...

Sounds like your ****ed. JUst going to be your word against the officers. Sounds like the only way to defend things like this is to have a speed datalogger or video cam in your car.
The last car of the cluster is always the one that gets screwed over. Best of luck to you.
