I'm in serious shit! 160kmh on a highway!
Hello, i need some advice
I was going back from Toronto Motorsports park today with a friend. Friend felt really sleepy and asked me to drive, so i did. I was going about 145-150kmh on QEW at 1am, there was barely any traffic. 20 seconds after i see i car FLYING past me (mustve been going around 200kmh), i see a cop car in my rear view mirror with the siren. I pull over, a cop comes to me saying "160kmh? Are you dumb?" I told him how i wasnt doing 160kmh, and he said that i was. So i told him that my speedo could be a little off (prob shouldnt've said that). So he says that if my speedo is off, i shouldnt be driving. He takes all my papers, comes back 5 min later with a yellow court notice and leaves. On the notice (not a ticket) it says that i was doing 160kmh in a 100 zone and that i should appear in court on sept 9th. I have full G licence and not a single ticket before this in 3 years of driving. Can anyone tell me what to do? What should i say in court? What penalty am i looking at? Any help appreciated. Thanks |
Did you ask to see his radar??? sounds to me like it might be a case of mistaken identity. Did you mention to the cop that you saw a car just pass you at a very high rate of speed before you were pulled over??? You better get a good lawyer! Your most likely looking at a careless or dangerous driving charge.

Tell me you never did 145 on a highway.. Its just that some people get lucky, others dont. Im not saying i wasnt guilty, i know i was, and i am going to pay for it. Thats not the reason i started the thread. I started the thread to find out from people who have experience in this sort of thing how to fight this, and exactly what kind of penalty/fine im looking at. Thank you And btw, i highly doubt that the cop got me with radar... i havent seen any cop cars parked on the highway. |

Either get a Lawyer or start doing your research.
You can start off by requesting disclosure. That way you will see how the cop clocked ya. See if you can reach a resolution with the prosecutor for 49 over, it might work because of your clean record... Insurance will rape you for 3 years, if the ticket stands, at least at 49 over (insurance still consider it minor) . |

what he gave you was a summons to appear in court.. thats why there is no fine and already a date.. that is the date he will be there for other fines, and the radar can get you while he is driving behing you.. coming on oncoming. sideways any ways trust me. i have a few cop buddies ad they provved it to me. casue i wasdriving and a cop was pacing me and he got me on radar.

I feel bad for those that ask for assistance on here - but only get BS replies.
Speeding (to an extent) is not what is wrong with our society... its assholes (like those that you can clearly see in this post) that are... Go to a ticket defender place - you will have to pay alot to get this resolved - but its worth it (seeing that its really your first offence) It iss easy for any cop to pull someone over and give them a ticket. I have seen more then I can count being dropped due to insufficient evidence (things that just don't line up). Some people do deserve what they get (don't get me wrong) but when I read about "safety blitz" and the stats of them handing out 1000 tickets in a weekend and all that... but then righ beside it you read about a murder and burglaries etc... (that if you follow up on - never get resolved) Why is that you ask... because all the cops were out looking for "street racers"... This wastes everyones time - and cops should be working on and solving REAL crimes - not taking the easy way out and handing out tickets. People helping people ???? (thats there slogan here in the KW region) LOL :) |

Btw, the speedo on my car goes to 300km/h, and it handles better at higher speeds than most cars on the road handle on the parking lot. In fact, speeding is the only traffic violation that i ever committed. And when i do speed, i never do it on small streets, parking lots, school areas, etc - anywhere where you "cant" speed.

Speeding is the smallest of the problems in this country. Very few accidents happen because of speeding. Germany has fewer accidents on the autobans than Canada on the 400series highways. To all those bitching at me for speeding, go to a highway and look at the cars there. Barely anyone is doing less than 120, and every minute i see people going WAY faster. I dont usually drive 140, but it was 1 AM, barely any cars on the road, i was tired and my friend wasnt feeling well (thats why i was driving his car), and i just wanted both of us to get home as soon as possible. You all talk like you never speed on teh highway.. What do you guys do? 100 in the damn slow lane? Who doesnt speed on the highway, not to sound like a moron, but fuk man, its difficult not to. I look up from my speedo for a second and im already doing 140, its difficult not to speed.

Not to step on your toes, but the reason Germany has fewer accidents on the autobahns compared to our 400 series highways has everything to do with their driver training and licensing. I guarantee that half of the members on this board would fail the German license exams at least 5 times. Our licensing system is a joke. Most licensed drivers in this country have no idea what the physical limits of their car are. Go ahead and ask the next person you talk to what the speed rating is on their tires. I bet you'll get a blank stare. Because of that, speed definitely kills. The autobahns are much better maintained as well. There is also the TUV inspections. All vehicles have to be inspected at certain intervals and must pass to be able to drive out of the inspection station. All modifications must be TUV approved. So there isn't any rolling junk on the road. Germany (and most of Europe really) has it right when it comes to the way drivers and vehicles are allowed on the roads.
I'm not saying that speeding is all bad though. I speed all the time. I just realize it has to be controlled and enforced because of how flawed our system is in how drivers and vehicles are allowed on the road. Sorry for the rant. Fight that ticket with whatever you've got. You really don't want a careless charge. |
Just go to POINTS court. They should be able to help you out. Small fee but if they dont win you dont pay! and they always win!

The yellow paper you were issued at the roadside is a summons for a hearing. It is not a trial, only a hearing. Save yourself some money and deal with the first part of this on your own. Go to the court office (address will be on the ticket) and request disclosure. This requires the roadside officer and prosecutor to provide all information that may be used against you in a trial. They'll typically have you fill out a form, and mail out the information once it's available. Attend the hearing on your own. At the hearing you may request that your case be stood down so you can discuss the matter with the prosecutor. If you are able to reach an agreement that is acceptable to both of you, the matter is usually resolved in court that day. If you are unable to reach an agreement, you should plead not guilty and request a trial date. With your clean driving record, the prosecutor shouldn't have a problem lowering the speed to 49 over, and if you're very lucky it may be reduced further. If he won't budge, take it to trial and go see Pointts or X-Copper to have them represent you. If you have any questions or aren't clear on anything, PM me. I've been through this personally, and on behalf of friends - don't get too stressed about it. Remember, there are people here willing to help! |

Find me one, and I'll find you 100 others that don't. Just two days ago I was passed by an OPP cruiser on the 401 travelling in excess of 150kph. No lights, no emergency - simply on his way back to the station. Worse yet, a sunfire is following the cruiser at speed no more than 10 feet from his rear bumper. The driver is obviously also a police officer, as no one else claiming to be sane would drive at that speed directly behind a cruiser. Sure enough, both of them pull in to the station together and stand in the parking lot talking. Neither officer has any excuse. This is not an isolated incident. gldwngr, when police officers begin to take highway speed limits seriously, come back and talk to us. Until then, take some advice from Thumper (small rabbit in Bambi) - "If you ain't got nothin nice to say, don't say nothin at all". |

If not, then how do you know why the cruiser was speeding, or that there was not a legitimate reason for that speeding, even if it was just to get back to the station, assuming you can verify that such was the case and not just a coincidence perhaps due to a cancelled call, etc.? Police officers in the performance of their duties are exempt from posted speed limits. You can look that up in the HTA. There is also no requirement to use lights and/or siren when speeding. In fact, response codes for even emergency incidents will often specify a fast but silent approach so as to not alert perps still at the scene. Police officers speeding in their personal vehicles shouldn't be treated any differently than other drivers. Sure, some may get let off when pulled over, same as any other driver who gets let off, but others do get ticketed same as everyone else who gets ticketed. |

There is a Toronto Police Services Board, but that is effectively the civilian management body to which the Toronto Police Services reports. Ontario law does not permit police to form unions. The exemption in the HTA is intended to protect officers from prosecution while lawfully engaged in the performance of their duties (ie. catching up with and pulling over a speeding motorist). It is NOT intended to provide blanket exemption from speed regulation while on duty or otherwise. |
