Shitty night, need some advice

First time ever getting tickets, OPP guy didnt like me I guess.
OPP pulled me over for speeding, big time speeding on HWY400. Over 50+kmph and he didnt drop it one bit.
He then holds up a flashlight checking lights and tells me my front signal lights are not yellow and thats against the HTA. He asks for my papers and I gave it to him. Then he comes back and says this is not what he wanted. I actually had the plate permit paper instead of my vehicle permit. Been pulled over so many times for random checks and not one Cop has ever mention it before.

Anyways, he takes his 5 minutes jerking off then comes back and slaps me with 2 tickets and a summons to court for speeding.

1 ticket for improler signal bulbs
1 ticket for improper papers
1 Summon to Court for speeding

Should I get someone like X-Copper or something to see if i can get rid of these?

rabbitman 07-10-2005 08:09 AM

Boy I guess he hasn't gotten laid in a while. I would definetly get some legal help. That's gonna be an expensive night.

You will always get some cops who follow the hta by the book. It has nothing to do with "liking" you. Just because some cops use discretion, doesn't mean that all cops have too.

Get signal bulbs and bring proper papers to show to the prosecutor. You can probably get those dropped. However, for that speeding ticket, I would highly recommend a LAWYER, not a paralegal agent like x-copper. It will get pricey, but still cheaper than facility insurance for 3 years.

A lawyer is a MUST.....unless of course, your father is Johnny Cochran.

Its your choice......

If anything get Theresa at Quest to fight your tickets.
Most other places will try to just talk them down and take your money,
She will try to beat them and take a little less then other places.

If u need the number send me a PM

CivicSiR00 07-11-2005 02:07 AM

Thx for the replies. If anyone has gotten a ticket that had to go to court send me a PM. Would like to hear what the penalty was.

You were a little evasive on a couple of points.
How fast were you going, and how fast does the ticket say? Do you agree you were going this fast?
What colour are your front signal lights? Why did the officer need a flashlight to check your signal lights?
One other thing, there is no such offence as "improper papers". You probably didnt quote that from the ticket, but can you? Did you have the vehicle permit with you?

If you hire an agent they are going to ask you these questions anyway.

Over 50km/hr, was I going this fast? Wasnt really looking at the speedomoter but most likely i was.
My signals are the same every car that changes them. They blink a white. Flashlight was mainly to see if my tires were rubbing? not sure he asked to turn the wheels one way and checked both sides really fast.

I had with me the plate permit thinking it was the vehicle permit. So when he came back, he didnt even ask if i had the vehicle permit, he wrote a ticket and came back with all of them and told me, ticket for signal lights not being with the HTA and 1 ticket for not showing the proper documents and then said a summons to court and turned around and said free to go.

Blacky 07-12-2005 02:53 PM

Dont get upset at the officer for writting you all these tickets. I say that for a couple of reasons. By your own admission you were travelling over the speed limit, and failed to produce the vehicle permit. So he was within his authority to write the tickets. The officer is probably somewhat expecting you to fight them. Even if he reduced the speeding you would probably still fight these charges right? If he did reduce them he would be tying the prosecutors hands.

Depending on your conviction history the prosecutor might offer to withdraw one or even both tickets if you plead guilty to the speeding. Prosecutors usually don't make deals if there is a previous conviction for the same offence.

So do you hire an agent? Well thats up to you. Some agents advertise a "we win or you don't pay" deal. That might sound good, but if they are able to negotiate any type of deal or reduction it is considered a win. Just remember that their fee may be higher than the cost of the ticket they had withdrawn. That means it costs you more money in the end.

CivicSiR00 07-12-2005 06:54 PM

Speeding i will have to hire an agent. The lights and paper ill do it myself. Ill change the lights and ill show them the proper papers.

97si 07-14-2005 07:41 AM

what section was your signal ticket under?
the HTA seems to only have provisioning for illegal signals green/red/blue

alnight 07-14-2005 08:40 AM

its nice that everyone is trying to make him feel good when the reality of the matter is that you are ed....you better get a real lawyer and let him take care of all three tickets instead of saying you will take care of the two minor ones because a lawyer will want all three....you probably drive a honda, and most honda drivers are idiot drivers anyway so you get what you deserve....the 400 isnt the autobahn.

2tone_93gt 07-14-2005 09:44 AM

Moosexing 07-14-2005 04:09 PM

I'm also curious....can you please type the exact wording from the signal light ticket with the Act and section number

Reality 101 for you buddy. I know that I am gona get scewed one way or another. Just asking for help from those that have been in the same situation and what kind of penalty he/she had gotten. You can keep driving your mom's minivan around and be happy with it.

Looked it up at the sticky post 2tone got up.

"improper clearance lights act 62(10) 85.00$

Same thing on the ticket.

alnight 07-16-2005 09:52 AM

yes i will keep driving my moms minivan and i will continue to have insurance on it...you on the other hand will be lucky if you can afford to keep your car because you wont be able to afford insurance once the courts are done with you....its a good thing that the speed limit signs are posted and there are still retards like you who think they are speedracer....oh well maybe i can buy your car from the classifieds when you cant afford it anymore....at least there will be one less on the road.

Clearance Lights HTA 62(10)

That officer is not the brightest light bulb (pardon the pun from the offence)

Read HTA 62(10)
Refers to wide vehicles, namely commercial motor vehicles, also further stipulates the vehicle has to be wider than 2.05 metres

So at least the signal offence was written on the wrong section of the HTA so it will be thrown out.....unless of course you were in a commercial motor vehicle and the officer measured the width of your vehicle.......and a Ford Crown Vic is only 1.98m wide.

Moosexing 07-17-2005 11:53 PM

Finally after 2 hours searching on Transport Canada website
************************************************** **
http://www.tc.gc.ca/roadsafety/mvstm...1080rev3_e.htm
************************************************** **

Technical Standards Document No. 108, Revision 3 Lamps, Reflective Devices and Associated Equipment, Schedule IV (4)

On the rear - 1 red or amber on each side of the vertical centerline, at the same height, and as far apart as practicable.

Side marker lamps On each side - 1 red as far to the rear as practicable, and 1 amber as far to the front as practicable

Intermediate side marker lamps On each side - 1 amber located at or near the midpoint between the front and rear side marker lamps.

Chubby_C 07-23-2005 12:28 AM

as it applies to the lights: install the proper bulbs/reflectors and get some pictures.
for the paperwork: bring it with you to court
by doing those things they may just drop them right off - happened to me for a license plate ticket
as for the speeding 50 over is 6 points according to the MTO website, best possible case is it is reduced to 49 over and then its only 4 points. They usually only reduce by 1 level: i.e. 50+ to 30-49km over.

But the best bet is to get a lawyer; remember the man who serves as his own laywer has a fool for a client.

and also getting legal advice from internet forums is like eating at Taco Bell; may taste good at first but you just end up with the shits

midrange 07-23-2005 11:09 PM

gotta hate the whole double ticket thing.. one time i was just going through a ride program, and the cop told me to pull to the side to tell me my lights are ilegal.. but the where bright yellowish orange. (they are those blazer fog lights you get from crappy tire and when they are off, the glass looks blue but when you turn them on, they are yellow) I said, no they are legal, so he made me get out and he said, i see a bit of blue in the light. I'm like whatever... got back in my car and drove off.. cause i was holiding up traffic.. picky ass bastards...

Way to bring back an old thread.

Alex 11-14-2005 08:38 PM

what happened?

CivicSiR00 07-04-2006 02:40 AM

Its old, but ill update this thread.
The speeding ticket was brought down 100 on a 100 zone. Lawyer told me something like, they cant make a ticket disapear. Its on record but it was reduced to a no speeding ticket. Was doing roughly 180 at the time.
Not having the papers, showed I had my papers, just not at the time and it got cleared.
Lights, dunno how, but I got busted for clear lights. Ticket was reduced to 40$ instead of the 110$

juniorali2003 07-07-2006 02:43 PM

that some serious . I definetly think you should go to x-coppers especially since he dint do you any favours like dropping the speed.
x-coppers are one of the more expensive places but compare the 800 dollars they may make you pay, to the leap in insurance that youre gonna have to pay and you will save a couple grand over the next three years. And with tikets such as that they could definelty get your points off and more. so its up to you.

79camaro 07-14-2006 12:42 AM

I got a guy that'll make it never exist but its a lil pricey but its a guarantee or dont pay at all if your serious....send me a phone number to reach you, name and offenses and ill talk to him and you'll hear back from him...
