Ticket question.

Ok so I typed the entire story out the other day and my internet screwed up so now I'm just gonna get to my question.

If one officer tickets you but the second officer in the cruiser inspects your vehicle and questions you on both the ticket you're getting and your car in general and makes false statements about its legality (tint, he realized his fault already and rear licence plate light - it was working at the time and still is), do BOTH of them have to be present at trial?

The only reason I ask this is because they both approached the car and the non-"ticketing" officer questioned me.

BTW in case anyone's wondering this is an "inproperly stop at stop sign" ticket in Durham. The cop said I cut them off coming out of the street...I didn't and repeatedly said I don't think I did...none the less they ticketed me.

This was after taking a long time after the intersection to pull me over. I asked them why they took that long after the intersection and the non-ticketing officer said cuz they were waiting to see if I was gonna speed. Well to court I go.

whos name is on the ticket - he is the one u will see in court.

u can beat this ticket ..

file for disclosure after u are given a court date

and when the time comes tell the judge that u looked left and right and came out of the intersection and the cop was flying down the road and you did not see him.

the judge is likely to belive your story if u have pictures etc .. I had a similar stop .. but i argued with the cop that he was speeding and going over 70 in 50 which is why i did not see him when i was entering the intersection.

was the cop behind you ? or to the right ? left? oncomming ?

^^^Ok so the chick is coming to court eh? Kool. Yeh I think I have a pretty solid defence seeing as how the distance that they were from the intersection they had no way of telling that I stopped at the stop sign. You can't tell by lights if I'm moving or not from that far perpendicular to me. And they certainly couldn't see the car not only cuz its night but its literally impossible with the house on the corner..lol.

Yeh I have pics of the other stuff but I didn't get ticketed for the lighths and tint. I am gonna take pics of the intersection with the house and stuff though and how far it was before they pulled me over.

The cop ended up behind me on the turn. I looked in my rear view all the way and they were at minimum 25-35 ft behind me at any given time. And yeh we were both going 70 when i got up to speed. 70 in a 60 though.

Court date set for Aug.20th. I filed for disclosure and waiting on it. Gonna head out to take all my pics necessary for my defence this weekend. I should be able to defend it and win this case based on 3 things.

1) They cannot see any car stopped or not in the intersection from where they were moreso at night.
2) I looked both ways, they were far enough, I went into the intersection and they were well behind me going 70km/h (not sure if I should mention the speed in court??)
3) They took a long time to pull me over...possibly trying to decide what they should ticket me with..?? not sure if I should day that last part either.

taking a long time to pull you over is not a defence.

The cop was probably just trying to find a safe spot for both you and him/her to pull over...

Sure it might not be a "defence" but court is like chess...some moves are just to get things on your side. And as for looking for a safe spot...ummm...no...this is in the suburbs along endless road away from intersections and in case you missed it....he answered my question as to why he took a long time to pop the cherries on...he was waiting to see if I was going to speed.
