is there anyway of getting out of this? saw a guy with his hood up getting owned by peel regional, a buddy was saying he went over to check it out and said the cop told him the guy had a boost pressure controller under the hood (in an obviously non turbo car) so this cop doesnt know wtf he's talking about... just curious how to fight this or avoid it?

Ask the Cop if he is a Class A.
Better yet tell him u were going to be a cop too but u decided to finsh high school.

Take pics of your car's underhood and date them. If you get a ticket, (which you prolly wont, cause a lot of ppl on here say they cant force you to open your hood without a warrant) take the pics to court and point to pics and say "look-non turbo" then point to cop and say "dumbass"

Thats right, i beleive that the only people that are allowed to legally make the correct decision are a ministry officer and/or a licensed class A technician.

so if i refuse to pop the hood, theres no much he can do about it right? i doubt i'll ever get into this situation but this is the one thing i'm not prepared for.... would like to know as much info as possible.

Your all talking about refusing the police to examine your vehicle for equipment violations. The police have more search authorities other than just the HTA, for example the Liquor licence Act also allows search without warrant. The police also have seizure authorities (again not just in the HTA). When the police seize a vehicle they take an inventory of the contents; trunk, passenger compartment, etc!

So if a police officer asks you to pop the hood, dont assume its for equipment violations and refuse. If they want to search your vehicle and they have the grounds to do so, they will be resourceful!

Vehicle equipment that is suspect/just plain illegal or a traffic violation do not constitute reasonable grounds for searching the car, including under the hood. A police officer is not in an authoritative position to determine whether or not emissions equipment is modified or intact.

However, like mentioned above, if the police find an ounce of coke in your car, reasonable grounds exist for a further search - giving them the right to search under hood for more illegal items if they so desire. This might mean you have to open your hood, but I doubt at this point they will care about your pcv breather.

You need to have a reason to seize, refusing to open the hood is not a valid reason. A lot of the times, the officer will ask you or intimidate, if you say yes, your basically volunteering. They dont need warrant to search vehicle, but for any evidence to stand up in court, they need reasonable grounds.

They need grounds to search vehicle, and have to tell the reason for the search. It's not like customs where they can do random inspections. Police can't do that. Often times, the general public agree to searches because if they dont, they believe the police will think that they are hiding something. Just like cops can be resourceful for finding reasons to search, you need to be resourceful thru information/education in protecting your rights.

Every police officer may require the driver/owner of any motor vehicle to submit the motor vehicle and equipment to the examinations and tests that the police officer may consider expedient.

I find it quite absurd that some suggest that police can not check a vehicles components. They do not have to be mechanics. 90% of the MTO officers are not mechanics, they attend a specialized training in vehicle components and how to check for defects. MOE (smog police) do similiar training.

Further, even yourself can check for your defects...how???
Refer to Highway Traffic Act, Regulation 611, Schedule 1
This section clearly identifies the main mechanical components of a vehicle and anyone can read this.....thus police carry this with them and could easily read in checking the main components.

We had a meet up in Hwy 7 & Leslie. 6 damn cop cars came and checked us out. gave us a few tickets for improper lighting, exhaust, breather,etc. Luckily my friend's S14 was from Jersey. He was heavily modified. He got away.

I'm almost positive that the above HTA section refers to an officer sending you to an inspection station. If you don't go you get the fine. Most police are not qualified in any way to inspect vehicle equipment. Aside from obvious and/or dangerous things such as tires rubbing or blue turn signals.

Clear and simple, a cop can pop your hood for suspicion of stolen property, or unsafe vehicle (rusted shock towers).

You want to rufuse them, your car will be seized and you get to pay the impound fees.

If you have all your emission stuff hooked up and a legit motor you have nothing to worry about.
