question about buying a modified car that failed etest

Im looking at buying an eclipse with a lot done to it, the problem is that it has a conditional etest right now. meaning its good for the guy who owns the car, but id have to get it etested. If i buy the car, and it fails the test(which it will because of the massive injectors and big *** fuel pump), what will happen. The car is FAR from stock, and ive been told that if the car is modified that they cant properly test it, so its a pass anyways. Does anyone know anything about this? thanks.
