Careless Driving - HELP please
A relative of mine just rear ended somebody at a traffic light at a low speed (approx 10-15km/h) unfortunately a police officer was called to the scene of the accident and a ticket of careless driving (6 pts and a fine of $300) when no one was injured, it was just an accident on the drivers behalf. The officer claimed if the ticket was taken to court it was likely to be reduced to 2 pts and $100.
SOMEONE HELP PLEASE
My goal is to help my relative's insurance from going up, does anyone think that the court might let her set it to no points and still a $300 fine, because the last thing she wants is her insurance to increase

No the points are non-negotiable, even a JP can not reduce points. But they can ammend a charge, in this case perhaps to "follow too close". That would reduce the points (and fine). You mentioned that your relative rear-ended someone. This was probably because they were in fact following too closely. Since the officer charged them with Carless driving I have to wonder if you didnt get all the facts about the accident from your relative.

Officers do that, charge with Dangerous/Careless and then tell you to take it to court so they can drop it down. Don't know why, but just take it to court and officer will most likely drop it to 2 pointer. Don't think you'll have any luck getting down to no points but you can always try.
If the driver is afraid of court or wants to make sure they get down to 2 points hire a traffic ticket lawyer.

i recommend you hire pointts. the guy in whitby is really good... but i would suggest that your relative pay for the peoples car that he hit. so they don't call the insurance, and they have no reason to show in court. thats what i did. but make sure when you file for a court date, that you check that the officer HAS to be there. cause otherwise they can still charge you. but if you pay for the guys damages, then the insuracne company does not know you had an accident, until you get charged, if you get charged. thats what i did. and the guy i hit didnt show so charge = dropped. no insurance raise.
