guys i was driving up in oshowa to see a friend in jail and a cop pulled me over he cought me on radar and gave me a fuked up ticket for $288 but thats not the worst part, he gave me a ticket for failure to show insurance card, but i showed him an old one since i didnt have insurance but he took the slip and said he would verify it and would bring me a summons if i didnt have insurance. what are the chances of him actualy giving me a summons and how much time does he have to bring it to me? cause right now im worried sick

He took your insurance pink slip and kept it? And then let you continue driving without it? Regardless, driving with no insurance is a pretty hefty fine, id probably get some real legal advice if i were you. Perhaps doing so before the pig has a chance to make good on his promise might be a good idea.

If I were you, I would have ran home and bought an insurance policy from the same insurance company.

Police have 3 years to charge someone under the Compulsory Automobile Insurance Act. The officer probably kept your old insurance card for evidence. If in fact your vehicle was insured, he could still charge you with fail to have insurance card (an expired card dosn't count).

Blacky, how would the officer go about laying charges? Would he have to deliver the documentation in person, or by registered mail, or another way? Also, if the officer kept his insurance card, how can he let the driver continue driving? It's like saying the cop took away his license and let him drive home. It just doesnt make sense.

Get insurance on the car. Chances are he'll be back and you can kiss your license, credit and anywhere from 1000-5000 dollars goodbye. Call points and see what they can do. Theres a loop hole but only an x-copper is gonna know it.

Go get insurance right away. I have been in that situation before. My friend is a cop with Peel Region and she told me that a cop cant tell if you have insurance or not. They are not hooked into the insurance brokers files. The only way that they can tell is if they call the insurance company. And if they did that, you would not be driving because they would impound your car and take your license on the spot. I won my case in court.

The police would charge someone after the fact by way of a summons. This is a document that is prepared by the officer then signed by a JP. Depending on the Police Service, that same officer may come knocking on your door to deliver it. Although some Police Services hire people just for that purpose.

As far as letting the vehicle drive away. Well, the officer simply has some doubt whether the vehicle is insured but not enough doubt to charge you at the time. In other words, he would be investigating it further by making a phone call to the insurance company.

In the meantime if someone were to call their insurance company and renew the cancelled policy, I doubt that would work. First of all because the policy would have to be back dated. Even if the company were to back date the policy by a few hours they would be commiting a fraud. They would not be willing to risk the consequences just to save you from a ticket. Just by asking them to back date a policy would raise questions right?

Also, it still doesnt make sense how the cop can take your insurance papers and let you drive away. He is essentially allowing you to break the law. What if another cop stopped you just after that, you think he's going to believe that the last guy took your insurance papers and let you drive away?

I think it doesnt matter because you can't be driving with the expired slip in the first place.

Not going to answer the door? Your just delaying the inevitable. Your going to have to tell everyone in your house not to answer the door. A summons can be left with someone that resides with you. In this situation you drive, and the police know what you drive. So anytime they see you they can serve you.

Planning on moving out of the province to avoid prosecution? That wont make it go away either. The police will mail the summons. When you get it, dont ignore it. They will hold the trial without you. The JP will review the evidence and since your not present you will be "deemed not to dispute", and found guilty as charged.

Now you know where "the long arm of the law" comes from!

Getting insurance right away wouldn't help in NOT getting you charged.

IF you get charged then getting that insurance at the last minute might just reduce the fine.

If the cop checks with the company, they will verify when you bought the insurance. So if you buy it after your ticket date obviously they're gonna know...
