there goes my paint job!
there goes my paint job!
sorry i don't know where this would belong but need help please
april 2005 -- so i drive a 97 integra with a new paint job and some guy in his mid 40's reversed right into me, ruining my paint job and bending in my fender. must suck huh? i stopped as i saw a truck was trying to reverse into a parking spot and he was infront of me unaware of what was happening. all of a sudden i see his reverse lights on -.-'' i swear i honked like a mad man hoping he'd stop. i got everyone else's attention but his. the fact that he reversed into me was already bad enough, he even tried to run. but i kept on honking so he finally pulled over. i tell him to give me his insurance papers to copy it down and he can go. but the guy says he doesn't have it. i had to call a cop over sayin if he doesn't show the insurance paper, he'd get a ticket for not having it while he's driving. first he started crying n sayin he has no money and he is living off welfare. i was only asking for $300, half of the price of the paint job. i think it's reasonable because after the accident, the paint started cracking. so after his emotional break down my friend finally made him sign a paper saying he'll pay me back within a year. he says that i caused him to stress and it's making him have medical conditions. isn't driving more of a stress issue?
anyway, it's been a good 7 months and i asked my girlfriend to call him asking to see if he has anything at all so i can pay for tuition. but the man says he doesn't have any money at all and he ain't gunna pay. he says "what you gunna do? bring me to court?" so what should i do? would claiming off his insurance make mine higher? i was thinking to consult my lawyer asking for legal advice. but i still wanna check out what you guys would say.

i can only see a situation like this being solved through small claims court now ... and it will most likely be messy and full of delays.
good news is, you had him sign an agreement to pay you back for the damages done to your car. bad news is, you put in that 1 year clause in the agreement, so technically even though it's been a good 7 months, he still has time to pay you back, and from the looks of it, he's stubborn, retarded or all of the above, which means you won't see a cent till after the 1 year period is up, and even then, you'll have to probably goto small claims court and force it out of him.
as for insurance, i'm not too sure if you can still claim and incident like this, since it's been quite a long time, and you might have waived your right to claim after you signed that agreement.
sorry, but if i were in your shoes at the time, i would have definately called the police after he failed to produce proof of insurance, and secured as many witnesses as possible. if he's too emotionally unstable to handle an accident he caused, he shouldn't be driving in the first place in my opinion. good luck tho, cuz i'm sure you'll be seeing more of the court system before this guy gives you any money

MVC (motor vehicle collisions) requiring a report be made are only done for the following reasons:
1) property damage (any sign, guard rail, lawn...anything damaged other than your vehicle)
2) personal injury (any person injured in any vehicle in a collision)
3) Damage OVER $1000
If none of these apply police do not have to complete a "traffic accident report", just would be a normal note book entry only

Heres a solution that worked for me many of times back in high school.
Go knock on his door.Bring a baseball bat and tuck it behind you so he cant see it.The minute he opens the door, take out his knees with the baseball bat. While hes down ask him for the money. If he says no allow yourself into his home and search for the amount he owes or somthing worth that much.Walk out the door and spit on his face on the way out.
