Ticket help

Ok a week ago i was driving home my girlfirends little cousions and didnt see the stop sign. i started to stop then i saw the cop and slammed on teh breaks stopping in teh middle of the stopping area. the guy was an *** and gave me a ticket. i tried explaining that iu didnt see the stop sighn beucase there was a tree covering it and could only see it when i was almost under it. i will add some picutures of the street and how the stop sighn was obstructed from my viewing. i was wondering if i can get out of the ticket and also if there are any laws against how far a sign should be seen clearly with out any obstruction.and any other tips ..thanks

oh man take those pics and fight that to the end.....you might have a good chance of it getting thrown out the city workers are suppose to look after that aswell good luck man

First of all there are no regulations regarding how far from an intersection a stop sign must be seen. But there is regulation about the size, height, and position of stop signs:

You didnt see any of the sign until you were directly under it? As your trying to stop you see a cop then slam on your brakes? If all of that is true then why should seeing a cop be a concern? Why is he an *** for giving you a ticket?

I looked at your photos and in every one the shape of the sign can be determined. Just because a portion of the sign is obstructed does not invalidate the sign. Think about the winter time, quite often the entire face of a sign is covered with snow. To get your drivers licence you needed to know what an octagon shaped sign was, a triangle shaped sign, etc.

Since you didnt see the sign until you were almost under it then had to slam on your brakes, perhaps you were going to fast. But with no evidence to support the speed theory I will assume that you were at normal driving speed. Therefore, you should have been able to see enough of the sign to determine its shape and therefore its purpose.

i went back the next day and took better pictures and did proper measurments for diffrent distances. in the middle of the street the stop sign could not be seen from 60 feet away+ because teh street had a bend in it. also i talked to a friend who is a cop and is representing me and he said that he could win the case because of the fact that the tree was not only covering the sign but it was alos touching it to. i wont have to fight this ticket until end of this year or even next year so its nto bothering me right now

My advice: Stop using "feets" and fight it. Get better pictures, where sign is less visible from driver's point of view.

Seems very justified that you will get off on the ticket.....not due to police error.........but city workers error.

If someone recognizes your "cop" friend that is supposed to be going to represent you, the officer can be charged under the PSA (Police Services Act) which is handled by various "professional standards bureaus" within each police force.

Section 2C.29 Advance Traffic Control Signs (W3-1, W3-2, W3-3, W3-4)
Standard:
The Advance Traffic Control symbol signs (see Figure 2C-4) include the Stop Ahead (W3-1), Yield Ahead (W3-2), and Signal Ahead (W3-3) signs. These signs shall be installed on an approach to a primary traffic control device that is not visible for a sufficient distance to permit the road user to respond to the device (see Table 2C-4). The visibility criteria for a traffic control signal shall be based on having a continuous view of at least two signal faces for the distance specified in Table 4D-1.
