Thank you for mentioning this.

I'm always surprised by how many people don't know that.

The only time an officer didn't show up for one of my tickets was because he retired in the 8 months it took to come to trial.

And no, you can't put the trial off indefinitely until your officer retires.

$5000 fine.

Second offence may be up to 10 K I believe.. Eventually up to jail time.

I can almost guarintee you that the cop will show up. No insurance is a serious offense and the cop will have to show unless in emerg.

I think we should not be misled about reasons for often cases when the officer does not show up in the court. Cops are people and drivers as we are and majority of them understand life around. So their not showing up or even their "mistakes" in documents (that lead to dismissing the charge) - are often their mercy to some of drivers...

In my "no belt" + "no insurance" case the cop showed up despite of he was on vacation these days. My lawyer talked to him before trial on: a) I got insurance fast - two days after the ticket, b) my financial situation is bad... then he requested interpreter for me and they could not find him (they did tried - by broadcasting it on court radio, but no one responded) ... they really did not want to postpone the trial again (once it was done by my lawyer) The cop approached prosecutor two times, talking to him - god knows what...

As a result "no insurance" was dropped (negotiated before the trial). And I plead guilty only on "no belt". After all done I asked my lawyer: what helped? He said three things:
1. procedural reasons - they could not find interpreter and really did not want to postpone the trial second time.
2. the cop was talking to them two times (I do not know about what)
3. my lawyer was talking to the cop and prosecutor
All I paid is $1000 for lawyer plus $115-"nobelt" plus insurance increase about $7/mo

I think the outcome paid off the hiring a lawyer. When I was hiring him he was honest with me, he told me he may be able, at most, to lower the fine $5000 approx by half, but there is always human factor that can really drive outcome in a court. I used him second time with no regret. Here is his info: Roy Tofilovski, 416-363-2270, rtof@rtlawyer.com.
